The PPV &amp; FR (Protection of Plant Varieties &amp; Farmers&#8217; Rights)\nAuthority is a legal body established under the <strong><em>Plant Varieties &amp; Farmers\u2019\nRights Act, 2001<\/em><\/strong>. <\/p>\n\n\n\n<p>So, PepsiCo&#8217;s IPR (<a href=\"https:\/\/swaritadvisors.com\/blog\/types-of-intellectual-property-rights\/\" class=\"text-primary\"><strong>Intellectual Property Right<\/strong><\/a>) granted on the potato variety in a Plant Variety Protection (PVP) Certificate in Feb 2016 will be taken back. The application to revoke or cancel the PVP Certificate was filed by <strong><em>Kavita Kuruganti (Activist) <\/em><\/strong>of the Alliance for Sustainable &amp; Holistic Agriculture on June 11, 2019.<\/p>\n\n\n\n<p>She\nhas also challenged that Intellectual Property Right granted to PepsiCo India\non a potato variety was not according to the provisions set up for registration\n&amp; was against the interest of the public. Additional, the Registration\nCertificate has been issued to an individual who is not liable for protection\nunder the Plant Varieties &amp; Farmers&#8217; Rights Act, 2001, and PepsiCo didn&#8217;t\nprovide the Registrar with such details, materials\/documents as needed, as per\nher petition.<\/p>\n\n\n\n<p>Protection\nof Plant Varieties and Farmers\u2019 Rights has approved the submission of Kuruganti\nand said the grant of the Registration Certificate was based on incorrect or\nwrong information provided by the applicant. As per the Registration\nCertificate dated February 01, 2016 issued by the Registrar in favour of the\nregistered breeder, i.e., PepsiCo, concerning the potato variety with\ndenomination <strong><em>FL-2027, it <\/em><\/strong>is hereby cancelled with immediate effect.<\/p>\n\n\n\n<p>In\nits judgment, Protection of Plant Varieties and Farmers\u2019 Rights has also come\ndown deeply on the Registrar, saying that <strong><em>\u201cthe Registrar being a shield of farmer&#8217;s\nright infringed the rules &amp; this has caused hardship to famer &amp; other.\nThis is totally unacceptable,&#8221;<\/em><\/strong> it added.<\/p>\n\n\n\n<p>The\nPPV and FR Authority directed the Registrar to develop s standardised sheet for\nevaluation of Registration Application of plant varieties as per the Act, Rules\n&amp; Regulations. The order said, \u201cRegistrar may also include a committee and\nsubmit the detailed report on how to avoid such matters in future\u201d.<\/p>\n\n\n\n<p>A spokesperson of PepsiCo said, &#8220;<strong><em>We are aware of the order passed by the authority and are in the process of examining the same. Therefore, at this moment, it would be premature to provide any comments<\/em><\/strong>\u201d. In the past, <strong>PepsiCo India<\/strong><sup><a href=\"http:\/\/www.pepsicoindia.co.in\/\" class=\"text-primary\"><strong>[1]<\/strong><\/a><\/sup> had used the Registration Certificate on FL-2027 to sue farmers in Gujarat in 2018 &amp; 19.<\/p>\n\n\n\n<p>PepsiCo&#8217;s\naction against farmers was relying on a non-existence exclusive right that it\nclaims to have obtained against Indian farmers, Kuruganti said. Kuruganti also\nsaid, \u201cThe Authority\u2019s judgement today also says this. On the other side, the\nIndian Legislation is unmistakable that farmers have over-arching rights over\nwhat seed they can use and what they are eligible for doing this with their\nproducts from any variety, comprising a seed of registered variety&#8221;.<\/p>\n\n\n\n<p>The\nonly situation is that farmers shouldn&#8217;t sell seeds of safeguarded varieties in\na brand fashion intentionally, she added. &#8220;Regardless of the law being\nthis clear, PepsiCo India bothered and intimidated farmers &amp; sued them for\nexcessive levels of alleged damages in2018 &amp; 19. Further, she said that the\njudgment brings to ling the procedural gaps in the issuance of Plant Variety\nCertificates.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion_%E2%80%93_PepsiCos_IPR\"><\/span>Conclusion &#8211;\nPepsiCo\u2019s IPR<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The revocation of the application was filed on June 11, 2019 and the PPV and FR Authority took almost thirty months in arriving at this conclusion. Now, the company has just about less than two months of the actual registration time duration left which is till January 31, 2022.
