License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nWeb Aggregator License issued by the IRDAI has a validity period of 3 years\nfrom the date on which the Authority issues it. However, the same can be\nrenewed by the company by following the renewal process laid down by the IRDAI.\nThe company can renew its Web Aggregator License unless it is suspended or\ncancelled by the Authority in pursuance of its regulations.<\/p>\n\n\n\n<p><strong>The Web Aggregator License Renewal is done as per the provisions of:<\/strong><\/p>\n\n\n\n<ul><li>The\nInsurance Act, 1938<\/li><li>The\nInsurance Rules, 1939<\/li><li>The\nInsurance Regulatory and Development Authority Act, 1999<\/li><li>The\nInsurance Regulatory and Development Authority of India (Insurance Web\nAggregators) Regulations, 2017<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conditions_for_Web_Aggregator_License_Renewal\"><\/span>Conditions for Web Aggregator License Renewal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To\nobtain the Insurance Web Aggregator renewal certificate, an applicant company\nmust fulfil the following eligibility criteria:<\/p>\n\n\n\n<ul><li>The company must fall under the definition of a \u2018person\u2019 under Regulation 2(k). This includes any company registered under the Companies Act, 2013; a limited liability partnership formed under the Limited Liability Partnership Act, 2008; any other person recognised by the IRDAI to act as a Web Aggregator in India. In case of an LLP, it must not have a non-resident entity or a person resident outside India as a partner in accordance with the Foreign Exchange Management Act, 1999. Additionally, the LLP must not be a foreign limited liability partnership.<\/li><li>The company\u2019s Memorandum of Association must lay down an object clause which states that the main objective of the business is web aggregation of insurance products.<\/li><li>The company must not be indulged in any other business activities other than its main object as stated in the MOA.<\/li><li>The company must not hold any appointment or registration as an insurance agent, company agent, micro-insurance agent, TPA, surveyor and loss assessor, insurance marketing firm or any other insurance intermediary in India.<\/li><li>The company must not be a part of any referral arrangement with any insurance company in India.<\/li><li>The company must have an active web-platform to execute its insurance web aggregation operations.<\/li><li>The Principal Officer must be an experienced professional, holding the qualifications as stated by the IRDAI in its regulations. <\/li><li>The Principal Officer must have undergone the training sessions and cleared the examination as necessitated by the IRDAI.<\/li><li>The fit and proper criteria as required under the IRDAI regulations must be fulfilled by the applicant company\u2019s principal officer, directors, promoters, shareholders, partners or key management personnel.<\/li><li>The authorised verifier must have undergone the training sessions and cleared the examination as necessitated by the IRDAI.<\/li><li>The Insurance Web Aggregator must have violated any the obligations or code of conduct specified under the IRDAI regulations.<\/li><li>The IRDAI must not have earlier rejected the company\u2019s application for insurance web aggregator license renewal.<\/li><li>The company must not have withdrawn the renewal application due to any reason during the previous financial year.<\/li><li>The foreign investor or Indian promoter of the company must have exited any time during the previous two financial years.<\/li><\/ul>\n\n\n\n<div class=\"embed-responsive embed-responsive-16by9\"><iframe loading=\"lazy\" class=\"embed-responsive-item\" src=\"https:\/\/www.youtube.com\/embed\/xr0LPSXKmBQ\" width=\"300\" height=\"150\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Eligibility_Qualifications_for_Principal_Officer\"><\/span>Eligibility Qualifications for Principal Officer <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As\nmentioned above, the Principal Officer of an Insurance Web Aggregator company\nmust be eligible under the Regulations and fulfil the following education\nqualifications:<\/p>\n\n\n\n<ol><li>The Principal Officer must\nhave a Bachelors or Masters degree in fields of Arts, Science, Social Sciences,\nCommerce, Engineering, Law or Management or an equivalent to such fields from\nany institution or university which has been recognised by any State Government\nor the Central Government, or<\/li><li>The PO must be an Associate\nor Fellow of the Insurance Institute of India, Mumbai, or<\/li><li>The PO must have a post-graduate\nqualification of the Institute of Insurance and Risk Management, Hyderabad, or<\/li><li>The Principal Officer must\nbe an Associate or Fellow of the Institute of Chartered Accountants of India,\nNew Delhi, or<\/li><li>The PO must be an Associate\nor Fellow of the Institute of Cost and Works Accountants of India, Kolkata, or<\/li><li>The Principal Officer must\nbe an Associate or Fellow of the Institute of Company Secretaries of India, New\nDelhi, or<\/li><li>The PO must be an Associate\nor Fellow of the Institute of Actuaries of India.<\/li><li>The PO must have the Certified\nAssociateship of the Indian Institute of Bankers, Mumbai, or<\/li><li>The PO must possess any\nother qualification as provided by the IRDAI from time to time under the IWA Regulations.\n<\/li><\/ol>\n\n\n\n<p><div class=\"shadow6\">The\nPrincipal Officer must also have completed the required training on insurance\nfrom a recognised institution by the IRDAI from time to time and passed the\ninsurance examination at the end of the training period. Such exams are\nconducted by an examination body recognised by the IRDAI. <\/div><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Insurance_Web_Aggregator_License_Renewal_Process\"><\/span>Insurance Web Aggregator License Renewal Process<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nfollowing process must be followed by an Insurance WA in India for its Web\nAggregator License Renewal:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Application_for_Web_Aggregator_License_Renewal\"><\/span>Application for Web Aggregator License Renewal<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\nWeb Aggregator company must file an application for renewal of its registration\nwith the IRDAI in Form F at least 30 days prior to the expiry of its Insurance Web\nAggregator License. The company also has the option to file an application for\nrenewal of its license 90 days before its Web Aggregator License expires as per\nthe process laid down by the IRDAI. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Document_Filing_and_Renewal_Fees\"><\/span>Document Filing and Renewal Fees<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\nrenewal application must be filed along with the prescribed documents to\nsatisfy the IRDAI that the company fulfils all the requirements to get its\nlicense renewed. The application for Web Aggregator License Renewal must be\nfiled along with a prescribed renewal fee of INR 25,000 plus applicable taxes.\nThe fees must be paid in the form of a bank draft drawn in favour of the Insurance\nRegulatory and Development Authority of India and payable at Hyderabad. The\nfees can also be paid by recognised electronic funds transfer methods.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Delay_in_Filing_the_Renewal_Application\"><\/span>Delay in Filing the Renewal Application<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If\nthe company fails to file its Web Aggregator License Renewal application at\nleast 30 days before the date of its expiry, the company would be liable to pay\nan additional fee of INR 100 as a penalty. In case of such delay and penalty,\nthe applicant company may provide sufficient reasons in writing to the IRDAI to\naccept the application. In this case, the Authority may accept a renewal\napplication even 60 days after the expiry of the license. The applicant, in\nthis case, must also pay an additional fee of INR 750.<\/p>\n\n\n\n<p>However,\nin such cases of delay, the IRDAI considers the Web Aggregator License Renewal\napplication only after the lapse of 12 months from the date on which the\nlicense of the applicant company expired. During this period, the license of\nthe Insurance Web Aggregator ceases to exist and the company cannot solicit any\nnew clients or carry out any other activities relating to insurance web\naggregation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Verification_by_the_IRDAI\"><\/span>Verification by the IRDAI<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\nWeb Aggregator License Renewal application is verified by the IRDAI to check if\nthe applicant fulfils the eligibility conditions, net owned funds,\ndirectors\u2019\/promoters\u2019 financial position, adherence to the code of conduct, fit\nand proper criteria, etc. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Training_of_the_Principal_Officer_and_Authorised_Verifiers\"><\/span>Training of the Principal Officer and Authorised Verifiers<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\nInsurance Web Aggregator must also verify that the Principal Officer and the\nAuthorised Verifiers of the company have received renewal training not more\nthan 6 months ago from the Web Aggregator License expiry date. &nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Grant_of_Insurance_Web_Aggregator_License_Renewal\"><\/span>Grant of Insurance Web Aggregator License Renewal <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Upon\nthorough verification and being satisfied that the applicant meets all the\nconditions laid down under the Regulations for renewal of Web Aggregator\nregistration, the IRDAI grants the Web Aggregator License Renewal to the\ncompany for a further period of 3 years.<\/p>\n\n\n\n<p>However,\nif the IRDAI finds that the Web Aggregator company has not performed the\ninsurance aggregation activities during its previous registration period,\nentirely or partly, it may refuse to renew the registration of the company.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Needed_for_Insurance_Web_Aggregator_License_Renewal\"><\/span>Documents Needed for Insurance Web Aggregator License Renewal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nfollowing documents are required to file an application for Insurance Web\nAggregator registration renewal in India and must be attested by the Principal\nOfficer of the company before submission:<\/p>\n\n\n\n<ol><li>Self-Certified undertaking\nin the format given in Annexure 1 of the Regulations.<\/li><li>Confirmation relating to the\nplace where the website of the company is being hosted. This includes places\nlike registered office or operations office in case there is a change in the\nplace. <\/li><li>List of individuals who\ncontrol the digital platform or are responsible for its management in relation\nto its activities of insurance web aggregation in case there is a change in\nsuch individuals.<\/li><li>Business Plan for at least\nthe next three years.<\/li><li>Certificates of Renewal of\nthe insurance training of the Principal Officer and Authorised Verifiers.<\/li><li>Bank Draft for the renewal\nfees.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rejection_of_Web_Aggregator_License_Renewal_Application\"><\/span>Rejection of Web Aggregator License Renewal Application<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>When\nan application for Web Aggregator License renewal fails to meet the\nrequirements and conditions laid down under the IWA Regulations, the IRDAI may\nrefuse to renew the Web Aggregator License registration of the company. <\/p>\n\n\n\n<p>However,\nin case the IRDAI finds an applicant to be unsatisfactory, it must give the\napplicant company an opportunity of being heard before rejecting its\napplication for license renewal.<\/p>\n\n\n\n<p>In\ncase of refusal to renew the company\u2019s Web Aggregator License, the IRDAI must\ncommunicate the same within 30 days of rejecting the application, along with\nthe reasons for such rejection of the application.<\/p>\n\n\n\n<p>However,\nin an event of rejection of renewal application, the applicant company can file\nan appeal against the decision of the IRDAI with the Securities Appellate\nTribunal. The appeal must be filed within 45 days of receiving the copy of the\norder made by the IRDAI. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Effect_of_Rejection_of_Web_Aggregator_Registration_Renewal_Application\"><\/span>Effect of Rejection of Web Aggregator Registration Renewal\nApplication<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>When\nthe application for Web Aggregator License Renewal is rejected or refused by\nthe IRDAI, the company ceases to act as an Insurance Web Aggregator from the\ndate on which such rejection is communicated to it. However, the company has an\noption to file a fresh application with the Authority when the IRDAI has cancelled\nits registration or rejected its renewal application. <\/p>\n\n\n\n<p>The\nfresh application for Web Aggregator License registration can be filed by such\ncompany only after a period of 12 months from the date on which the IRDAI\npassed its decision. In case the IRDAI\u2019s decision is upheld in any legal matter\nsuch as appeal, the registration application of the company would only be\nconsidered after 12 months from the date on which the court passes its final\njudgement.<\/p>\n\n\n\n<p>The\napplication for Web Aggregator License registration by the company whose\nlicense was cancelled or renewal application was rejected in case of surrender\nor any disciplinary action would be accepted only after the due diligence\nprocess for the following is successfully completed: <\/p>\n\n\n\n<ol><li>The severity of the previous\nregulatory violations.<\/li><li>Lead Management System\nmodel and the current infrastructure setup of Insurance Web Aggregator.<\/li><li>Persistency of the business\nover the years.<\/li><li>The complaints filed\nagainst the Insurance Web Aggregator by insurance companies associated with it\nor its customers.<\/li><li>Due diligence and\ntrack record of the company\u2019s activities.<\/li><li>Other details filed\nalong with the application.<\/li><li>Any other information\nas specified from time to time by an order or guideline by the IRDAI.<\/li><\/ol>\n\n\n\n<p>The IRDAI appoints a special committee to evaluate\nsuch application, and makes a decision regarding its rejection or grant of a\nnew Web Aggregator License as per the suggestions from the committee. <\/p>\n\n\n\n<p><div class=\"shadow4\">The process of Insurance Web Aggregator License\nRenewal can seem complicated if a company plans to handle it on its own without\nany guidance from IWA experts. Additionally, one wrong step can lead to the\napplication getting rejected by the IRDAI. This is why assistance from business\nexperts become essential while applying for Insurance Web Aggregator License\nRegistration or its renewal.
