Central Government allots this number to each individual who wants to become a Director. An already acting director also needs to obtain <strong>DIN from the Central Government<\/strong>. <\/p>\n\n\n\n<p>A person can have only one <strong>DIN number<\/strong>. However, he is eligible to become director of two or more companies. A <strong>Director Identification Number<\/strong> has lifetime validity. Through a <strong>DIN government<\/strong> can maintain a database of all the directors. <\/p>\n\n\n\n<p>The <strong>concept of this Identification Number<\/strong> was introduced in <em>section 266A to 266G the Companies (Amendment) Act, 2006<\/em>. A director of a company while signing documents like Annual Return needs to mention his DIN below his signature as well. Further, the fee charged for <strong>obtaining DIN<\/strong> is Rs 500.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Latest_Update_as_on_24032020\"><\/span>Latest Update as on 24.03.2020<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>All the <strong>DIN holders<\/strong> named as \u201c<strong>Deactivated<\/strong>\u201d can <strong>file e-form DIR-3 KYC<\/strong> or f<strong>orm DIR-3 KYC-Web<\/strong> by 30.09.2020. These holders can submit this form without <em>paying the fees of Rs 5000<\/em>. <\/p>\n\n\n\n<p>Further, the companies termed as \u2018<strong>ACTIVE Non-Compliant\u2019<\/strong> can <em>file e-form ACTIVE up to 30.09.2020<\/em>. The supporting documents required to be filed with SPICE Form includes the following:<ol><li>Identity Proof in the form of Aadhar Card, Voter ID, or PAN Card;<\/li><li>Address Proof in the form of Utility Bill;<\/li><\/ol><\/li><li><strong>With Form DIR-3<\/strong>: Any person who wants to become a director in an existing company needs to make an <strong>application in e-Form DIR-3<\/strong>. The documents required for the same can be summarised as:<ol><li>Photograph:<\/li><li>Proof of Identity in the form of Aadhar Card, Voter ID, or PAN Card;<\/li><li>Residence Proof in the form of Utility Bill;<\/li><li>In the case of Foreign Nationals, a copy of the Passport.<\/li><\/ol><\/li><li><strong>Verification Details<\/strong>:<ol><li>Applicant\u2019s Name;<\/li><li>Father\u2019s name;<\/li><li>Current Address;<\/li><li>Date of Birth;<\/li><li>Declaration Text;<\/li><li>A physical signature of the applicant.<\/li><\/ol><\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Procedure_to_obtain_Director_Identification_Number\"><\/span>The Procedure to obtain Director Identification Number<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><em>In India, the legal provisions <\/em><strong><em>regulating the DIN<\/em><\/strong><em> are as follows:<\/em><\/p>\n\n\n\n<ol><li>Section 153\nof the Companies Act, 2013;<\/li><li>Rule 9 of the\nCompanies Rules, 2014.<\/li><\/ol>\n\n\n\n<p><em>Further, the steps involved in the <\/em><strong><em>procedure for receiving DIN<\/em><\/strong><em> can be summarised as:<\/em><\/p>\n\n\n\n<ol><li>In the first step, the applicant needs to visit the <strong>official website of the MCA<\/strong> <a href=\"http:\/\/www.mca.gov.in\/MinistryV2\/applyfordin.html\">[1]<\/a> ;<\/li><li>Now select the drop-down menu saying MCA services;<\/li><li>After choosing the MCA services, search the <strong>E-Filing section<\/strong>;<\/li><li>Next click on the option \u2018Company Forms Download\u201d;<\/li><li>Now on the Next Page, find Form DIR-3 under \u201c<strong>DIN Forms<\/strong>\u201dsection and download it;<\/li><li>After downloading the e-form, fill the same with all the details asked;<\/li><li>Attach a copy of each Supporting Document with the application form;<\/li><li>Now, the applicant needs to sign all the documents using DSC (<strong>Digital Signature Certificate<\/strong>);<\/li><li>After that, all the documents need to be digitally signed by Company Secretary or Manager;<\/li><li>The CEO (<strong>Chief Executive Officer<\/strong>) or CFO (<strong>Chief Financial Officer<\/strong>) to sign the documents digitally;<\/li><li>Lastly, <strong>submit the e-form<\/strong> with the specified fees as per the official instruction.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_is_DIN_allotted\"><\/span>How is DIN allotted?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Delegated Authority process and <strong>validate the Form DIR-3<\/strong> filed by the applicant. The regulations considered for <strong>validating the DIN<\/strong> can be summarised as: <\/p>\n\n\n\n<ol><li><strong>154 of the Companies Act, 2013<\/strong> <a href=\"http:\/\/www.mca.gov.in\/MCASearch\/search_table.html\">[2]<\/a> ;<\/li><li>Rule 10 of the Companies Rules (<strong>Appointment and Qualification of Director<\/strong>) 2020. <\/li><\/ol>\n\n\n\n<p>After considering these rules and provisions, the <strong>DIN number<\/strong> will be allotted within a month. However, the central government reserve the right to accept or reject the form. <\/p>\n\n\n\n<p>In case the application gets rejected,\nthe authorities will send an e-mail stating the reason for rejection to the\napplicant. The authorities will also put the reasons on the official website as\nwell. <\/p>\n\n\n\n<p>The applicant will get a time of 15 days to rectify the reasons or objections raised. Further, if the applicant rectifies the reasons and satisfies the authorities, he will be <strong>allotted DIN<\/strong>. However, if he fails to rectify, the central government will label the said application as \u201c<strong>INVALID<\/strong>\u201d.<\/p>\n\n\n\n<p>Once, a director has <strong>received the DIN<\/strong>; he needs to inform about the same to the company.
