In this situation, a manufacturer can <strong>claim ITC<\/strong> on Rs 300 and needs to deposit on <strong>Rs 150<\/strong><\/div>\n\n\n\n<p>The concept of ITC is not new to our country, as it existed in the pre-GST regime as well. However, the scope ITC has now been widened <strong><em>under the Goods and Services Act<\/em><\/strong> <a class=\"text-primary\" href=\"https:\/\/cbic-gst.gov.in\/pdf\/CGST-Act-Updated-30092020.pdf\">[1]<\/a> . Earlier, a manufacturer was not eligible to claim an input tax credit for the different types of taxes as follows:<\/p>\n\n\n\n<ol><li>Central\nSales Tax; <\/li><li>Entry\nTax; <\/li><li>Central\nExcise Duty;<\/li><li>Luxury\nTax and other taxes. <\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_can_claim_ITC\"><\/span>Who can claim ITC?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>An ITC can be claimed by any person registered under GST if he satisfies all the conditions as follows:<\/p>\n\n\n\n<ol><li>The registered dealer must have the tax invoice;<\/li><li>The said goods or services have been received;<\/li><li>Returns have been filed on time;<\/li><li>The supplier has paid all the tax charged to the government;<\/li><li>Whenever the goods are received in Installments, the ITC can be claimed when the last installment\/ lot is received;<\/li><li>A manufacturer cannot <em>claim ITC<\/em> if depreciation has been charged on the tax component of a capital good.<\/li><\/ol>\n\n\n\n<p>However, any person registered under the <strong>Composition Scheme<\/strong> <a href=\"https:\/\/cbic-gst.gov.in\/pdf\/faq-manual\/faq-composition-levy-revised.pdf\">[2]<\/a>  is not liable to pay tax.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_can_be_claimed_as_ITC\"><\/span>What can be claimed as ITC?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>A taxable person can <strong>claim ITC<\/strong> only for business purposes. That means a person cannot <strong>claim ITC on the goods or services<\/strong> as follows: <\/p>\n\n\n\n<ol><li>Personal Use; <\/li><li>Exempt supplies;<\/li><li>Supplies for\nwhich ITC is explicitly not available.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_time-limit_to_avail_ITC\"><\/span>What is the time-limit to avail ITC?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>A registered person needs to <strong>claim ITC<\/strong> in a specific manner and time frame. Further, the table given below shows the different situations in which the ITC can be claimed for finished or semi-finished goods:<\/p>\n\n\n\n<table class=\"wp-block-table\"><tbody><tr><td><strong>Situations<\/strong>   <\/td><td><strong>Claim of ITC<\/strong>   <\/td><\/tr><tr><td>If a person has applied for <strong><a class=\"text-primary\" href=\"https:\/\/swaritadvisors.com\/gst-registration\">GST Registration<\/a><\/strong> or is granted registration   <\/td><td>Day   from when he is liable to pay taxes   <\/td><\/tr><tr><td>When a person takes up a voluntary registration   <\/td><td>Date of Registration   <\/td><\/tr><tr><td>When a taxable person stops paying taxes under the Composition Levy Scheme   <\/td><td>Day from which he is liable to pay tax normally under section 7.   <\/td><\/tr><\/tbody><\/table>\n\n\n\n<p>In these situations, the registered dealer can <strong>claim ITC<\/strong> only if one year has not passed from the date on which the invoice concerning supply was issued. For any other case, the <strong>Input Tax Credit<\/strong> can be claimed earlier of the following:<\/p>\n\n\n\n<ol><li>Furnishing of <strong>Annual Return<\/strong>;<\/li><li>Due date of filing the monthly <strong><a href=\"https:\/\/swaritadvisors.com\/gst-return-filing\" class=\"text-primary\">GST return<\/a> (GSTR-3<\/strong>) for the next financial year is September month.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_Claim_Input_Tax_Credit\"><\/span>How to Claim Input Tax Credit?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>All the regular taxpayers need to report the amount of ITC in their monthly <strong>GST returns in Form GSTR-3B<\/strong>. Table 4 needs a summary figure of the <em>eligible and ineligible ITC<\/em> along with ITC reversed during the tax period. The specimen of Table 4 is provided below:<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/07\/itc.jpg\" alt=\"eligible and ineligible ITC\" class=\"wp-image-11402\" width=\"513\" height=\"385\" srcset=\"https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/07\/itc.jpg 960w, https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/07\/itc-300x225.jpg 300w, https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/07\/itc-768x576.jpg 768w\" sizes=\"(max-width: 513px) 100vw, 513px\" \/><\/figure><\/div>\n\n\n\n<p>A registered taxpayer is <strong>eligible to claim ITC<\/strong> on a provisional basis in the <strong>form GSTR-3B<\/strong>. He can<strong> claim ITC up to 20%<\/strong> of the <strong>eligible ITC<\/strong> reported by suppliers in an auto-generated <strong>GSTR 2A return<\/strong>. Therefore, a taxpayer must verify the <strong>figures of GSTR 2A<\/strong> before <strong>filling GSTR 3B<\/strong>.<\/p>\n\n\n\n<p>Normally, a taxpayer was eligible to claim provisional ITC till 09.10.2019. However, as per the new CBIC ruling, from 09.10.2019, a taxpayer cannot claim more than 20% of the eligible ITC. That means from 09.10.2019, GSTR 3B will be the total of the actual ITC in GSTR 2A and the provisional ITC in the GSTR-2A. Thus, matching of the expense ledger or purchase register with the GSTR-2A becomes crucial.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Reversal_of_Input_Tax_Credit\"><\/span>Reversal of Input Tax Credit<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><em>In India, the situations on which the ITC will be reversed can be summarised as:<\/em><\/p>\n\n\n\n<ol><li>Non-payment of Invoices within 180 days;<\/li><li>Seller issues credit note to the ISD (<strong>Input Service Distributor<\/strong>);<\/li><li>Inputs which are partly for personal use and partly for business purpose;<\/li><li>Capital goods which are partly for personal use and partly for business purpose;<\/li><li>If the inputs of exempted goods are more than the ITC reversed, then the difference will be added to output tax liability.<\/li><\/ol>\n\n\n\n<p>Further, the details of the reversal of ITC must be furnished in <strong>GSTR-3B<\/strong>. Moreover, the ITC claimed by the taxable person must match with the details submitted by the supplier in his <strong>GST return<\/strong>. However, if there is a mismatch, the authorities would ask the recipient and supplier to file returns again.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Needed_for_Claiming_ITC\"><\/span>Documents Needed for Claiming ITC<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><em>In India, the <\/em><strong><em>documents needed for claiming ITC<\/em><\/strong><em> can be summarised as:<\/em><\/p>\n\n\n\n<ol><li>Tax Invoice issued by the supplier of services and goods;<\/li><li>The Debit Note issued by to recipient by the supplier;<\/li><li>Bill of Entry;<\/li><li>An invoice issued under situations like:<ul><li>Issuance of Bill of Supply (BOS) instead of Tax Invoice;<\/li><li>If the amount of invoice is below Rs 200; or <\/li><li>Cases where the reverse charge mechanism is applicable as per the GST Act.<\/li><\/ul><\/li><li>A Credit Note or invoice issued by the ISD;<\/li><li>BOS issued by the supplier of services or goods or both.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Eligible_and_Ineligible_Claims_of_ITC\"><\/span>Eligible and Ineligible Claims of ITC<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><em>The purchases <\/em><strong><em>eligible to claim ITC benefits<\/em><\/strong><em> can be summarised as: <\/em><\/p>\n\n\n\n<ol><li>Intra-State Sale or Resale;<\/li><li>Interstate Trade or Commerce;<\/li><li>Used as Consumables Stores, Raw Materials, or Packing Materials to be sold Intra-country or Abroad;<\/li><li>Used for the Execution of the Work Contract;<\/li><li>Used as <em>Capital Goods for Manufacturing<\/em> or Reselling the taxable good;<\/li><li>Used for making Zero-Rated Sales.<\/li><\/ol>\n\n\n\n<p><strong>The situations in which one can claim ITC benefits can be summarised as:<\/strong><\/p>\n\n\n\n<ol><li>Goods from Unregistered Dealers or Dealers Registered under\nthe Composition Scheme;<\/li><li>Goods mentioned in the Negative List;<\/li><li>Goods bought without Tax Invoice.<\/li><li>Goods bought with Tax Invoice but without a separate mention\nof tax amount;<\/li><li>Goods bought for manufacturing exempted items other than\nexports.<\/li><li>Goods purchased for personal use or received as a gift; <\/li><li>Goods bought from abroad;<\/li><li>Interstate goods purchases.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The Implementation of GST has changed the dynamics of Indian Indirect Taxation.
