Any undertaking carrying out activities like Manufacturing, Storage, Distribution, or Sale of the food product is known as a Food Business. <\/p>\n\n\n\n<p>Catering services, food services, and the sale of food ingredients are also included in the <strong>definition of Food Business<\/strong>. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_are_Food_Business_Operators\"><\/span>Who are Food Business Operators?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per <em>section 3(1)(o) of the Food Safety and Standards Act, 2006,<\/em> any person who owns or is responsible for confirming the compliance of this act is known as a Food Business Operator. Further, the <strong>definition of FBO includes the following<\/strong>:<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/07\/Food-Business-Operators-683x1024.png\" alt=\"list of Food business operators\" class=\"wp-image-11459\" width=\"545\" height=\"817\" srcset=\"https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/07\/Food-Business-Operators-683x1024.png 683w, https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/07\/Food-Business-Operators-200x300.png 200w, https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/07\/Food-Business-Operators-768x1152.png 768w, https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/07\/Food-Business-Operators.png 1000w\" sizes=\"(max-width: 545px) 100vw, 545px\" \/><\/figure><\/div>\n\n\n\n<ol><li>Manufacturer;<\/li><li>Entrepreneurs\nengaged in packaging or transporting food;<\/li><li>Wholesalers;<\/li><li>Retailers;\n<\/li><li>Hotel\nOwners;<\/li><li>Fast\nFood Entrepreneur;<\/li><li>Tea\nShop Owner;<\/li><li>Managers\ncarrying food business;<\/li><li>Importers of Food;<\/li><li>Exporter of Food;<\/li><li>Hawkers\nwho are operating in Fairs and Tourist Spots.<\/li><\/ol>\n\n\n\n<p><div class=\"shadow4\">However,\nIterant Vendor, Small-Scale FBOs, Cottage Food Industries, are not included in\nthe definition of Food Business Operators.<\/div><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Duties_of_Food_Business_Operators_in_India\"><\/span>Duties of Food Business Operators in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><em>In India, the<\/em><strong><em> duties of Food Business Operators<\/em><\/strong><em> are as follows:<\/em><\/p>\n\n\n\n<ol><li>An FBO needs to comply with all the stages of production along with the production, processing, import, distribution, and sale of the food product;<\/li><li>An FBO <em>can not manufacture<\/em>, sell, store and distribute any article of food which is not safe for human consumption;<\/li><li>An FBO <em>can not sell sub-standard<\/em> or mis-branded food product;<\/li><li>An FBO c<em>annot sell food product that contains extraneous matter<\/em>;<\/li><li>An FBO cannot sell food product that needs prior license or permission from the FSSAI;<\/li><li>An FBO cannot sell food product that is prohibited by the FSSAI or central\/ state government;<\/li><li>An FBO cannot employ any person or worker suffering from contagious, infectious or loathsome disease;<\/li><li>An FBO must not engage itself in <em>selling or offering for sale food<\/em> articles to the vendor. It needs to give a declaration or guarantee in writing in the form specified by the regulations. The declaration must specify the nature and quality of such article.<\/li><li>An FBO cannot sell a food product which is a part of a batch unsafe for human consumption. In this case, a detailed assessment is carried out for the whole lot within a specified time. If no evidence found in against, then the rest of the batch will be considered safe for consumption;<\/li><li>An FBO must ensure sanitary, hygiene, and safety of the food products offered;<\/li><li>An FBO must obtain an <strong><a href=\"https:\/\/swaritadvisors.com\/fssai-license\">FSSAI License<\/a><\/strong> from the FSSAI before supplying food to any vendor.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Food_Safety_Training_and_Certification_Program\"><\/span>Food Safety Training and Certification Program<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>It is an online training program mandatory for <strong><em>every FBO licensed under the FSS Act, 2006<\/em><\/strong>. This program aims to confirm the safety and hygiene across the food supply chain. Every licensed food business must have at least one certified and trained food safety supervisor in its premise. <\/p>\n\n\n\n<p><em>Due to COVID-19 epidemic<\/em>, it has become mandatory for all the stakeholder of the food eco systems to obtain training under this program. The term \u201c<strong>stakeholder<\/strong>\u201d includes Manufactures, packagers, retailers, and transporters, etc. <\/p>\n\n\n\n<p>The\nFood Business Aggregators, NGOs running community kitchen like langar also\nneeds to get their food handlers trained for precautionary measures. <\/p>\n\n\n\n<p>After the completion of training, the <strong>FoSTaC portal<\/strong> <a class=\"text-primary\" href=\"https:\/\/fostac.fssai.gov.in\/index\">[1]<\/a>  will issue a certificate of participation to each FBO.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>To summarise, the principal duty of a food business operator is to ensure the safety and hygiene of its food product.
