It provides that the applicant needs prior permission of the government to use the prohibited names. <\/li><li>The <strong>Emblems Act, 1950<\/strong>, also restricts the use of the name of \u201c<strong>national heroes<\/strong>\u201d. Therefore, it is advisable to all the societies to consult with advisors before proposing the name for the society\u2019s registration.<\/li><li>A Society cannot use any name of the company or society already registered. As it will lead to the <strong>duplication of the registered name<\/strong>. <\/li><li>The MOA (<strong>Memorandum of Association<\/strong>) of the Society should provide the information as follows: <ul><li><em>Name of the Society;<\/em><\/li><li><em>The objective of the Society;<\/em><\/li><li>Details and Particulars regarding name, address, and professions of the governors, director, council, and committee;<\/li><\/ul><\/li><li><em>The by-laws<\/em>, rules, and regulations must be certified by at least three members of the governing body. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Aims_and_Objectives_of_the_School_Registered\"><\/span><strong>Aims and Objectives of the School Registered <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The objectives of the School registered under the Societies Registration Act, 1860 <\/em><\/strong><a href=\"https:\/\/www.mca.gov.in\/Ministry\/actsbills\/pdf\/Societies_Registration_Act_1860.pdf\"><strong><em>[1]<\/em><\/strong><\/a><strong><em> , can be summarised as:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Open and run vocational and educational schools to teach poor and backward class children;<\/li><li>Maintain libraries and arrange and publish books on cultural, educational and social topics;<\/li><li>Organised debates, seminars for imparting knowledge about the surroundings of the people;<\/li><li>Provide hostels to the students, physically disabled or specially-abled;<\/li><li>Provide vocational training for the semi-skilled jobs to physically disabled people;<\/li><li>Ensure the best education available at affordable rates;<\/li><li>Emphasis on shaping up the character of the students;<\/li><li>Work on the skills like discipline, and growth of social and cognitive faculties;<\/li><li>Create a healthy and suitable environment for the students;<\/li><li>Organise social and cultural platforms like annual day, kiddo fest, sports fest, food fest, etc.; <\/li><li>Utilise all the funds on the movable and immovable properties especially for the objects specified in the MOA;<\/li><li>lastly, offer free meals, clothes to the children from the backward section of the society.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Society_get_Sued\"><\/span>Can a Society get Sued?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Yes, as per <strong>section 6 of the Act<\/strong>, a registered society is a body corporate. That means it is <strong>eligible to sue and get sued<\/strong> by the third party.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Society_Registration_for_School_Sources_of_Income\"><\/span>Society Registration for School: Sources of Income<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The following are the sources of income for a school registered under the Act:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Fees through Admissions;<\/li><li>Capital Fund of the Educational Society;<\/li><li>Funds collected through Donations and Favours;<\/li><li>Funds acquired by the Subscription and Donation from the members;<\/li><li>Aid from Central or State governments;<\/li><li>Funds from charitable trusts, institutions, and associations;<\/li><li>Lastly, the Funds collected as donations from foreign charitable institutions.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Audit_of_the_Educational_Societies\"><\/span>Audit of the Educational Societies<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Every <strong>educational society<\/strong> must get the audit of their accounts done at least once a year. Moreover, he\/she has full powers delegated to the President.<\/li><li><strong>Secretary:<\/strong> The roles and responsibilities of a secretary are as follows:<ul><li>Sign documents on behalf of the school;<\/li><li>Bear all its correspondence;<\/li><li>Record the minutes of the General Body Meetings;<\/li><li>Summon and appear in the meetings of society;<\/li><li>Hold an ordinary general meeting of the society on the written request.<\/li><\/ul><\/li><li><strong>Treasurer:<\/strong> A Treasurer is responsible and accountable for maintaining the books of account.
