We need them to preserve or restore our health. Hence, they are also known as life saving remedies. Further, in India, the <strong><em>Drugs and Cosmetics Act of 1940<\/em><\/strong> acts as governing law for drugs and cosmetics. Furthermore, in this blog, we will discuss the laws relating to <strong>Restrictions on Manufacture, Sale and Distribution of Drugs<\/strong>. <\/p>\n\n\n\n<p>There were two main aims behind the <em>enforcement of Drug laws in India<\/em><a href=\"https:\/\/www.ncjrs.gov\/App\/Publications\/abstract.aspx?ID=151230\">[1]<\/a> . The first was to provide drugs and cosmetics to the consumers at a fair price. And second to curb the exploitation of consumers from adulterated, misbranded drugs and cosmetics.<\/p>\n\n\n\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_65 counter-hierarchy ez-toc-counter class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The cosmetics and drugs which are made as per the standards specified in the second schedule are known as <strong>standard quality cosmetics and drugs<\/strong>. <\/p>\n\n\n\n<p>Further, the Central Government, together with the <strong>Drugs Technical Advisory Board<\/strong><a href=\"https:\/\/cdsco.gov.in\/opencms\/opencms\/en\/dcc-dtab-committee\">[2]<\/a> , can amend the second schedule.<\/p>\n\n\n\n<p>Furthermore, the government needs to\ngive at least three months notice before amending the schedule second.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Restrictions_on_Manufacture_Sale_and_Distribution_of_Drugs_and_Cosmetics\"><\/span>Restrictions on Manufacture, Sale and Distribution of Drugs\nand Cosmetics<span follows:<\/strong><\/p>\n\n\n\n<ol><li>Sub-standard\nQuality Drugs and Cosmetics;<\/li><li>Misbranded Drugs\nor Cosmetics;<\/li><li>Adulterated\nDrugs or Cosmetics;<\/li><li>Spurious Drugs\nor Cosmetics;<\/li><li>Patent or\nProprietary Medicine;<\/li><li>Counterfeit\nDrugs or Cosmetics;<\/li><li>Manufacture,\nSale and Distribution of drugs and cosmetics against the provisions of this\nact.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_Sub-standard_Quality_Drugs_and_Cosmetics\"><\/span>Concept of Sub-standard Quality Drugs and Cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Any <strong>pharmaceutical product<\/strong> or cosmetic that does not qualify the prescribed quality standards and specifications is known as <strong>Sub-standard Quality Drugs or Cosmetics<\/strong>. <\/p>\n\n\n\n<p>Further, these specifications and standards are regularly assessed, reviewed, and <strong>approved by the NMRA<\/strong> before the drug is authorised for marketing. Furthermore, the acronym <strong><em>NMRA<\/em><\/strong> stands for the <strong><em>National Medical Regulatory Authority of India.<\/em><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_Misbranded_Drugs_or_Cosmetics\"><\/span>Concept of Misbranded Drugs or Cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The definition of <strong><em>Misbranded Drugs<\/em><\/strong> is given under <strong>s<em>ection 17 of the Drugs and Cosmetics Act, 1940<\/em>.<\/strong> As per this definition, a Drug will be considered as Misbranded in the following situations:<\/p>\n\n\n\n<ol><li>If it is coated, colored, polished or powdered to conceal the\ndamage or make it appear as of better quality than it really is;<\/li><li>If it is not\nproperly labeled;<\/li><li>If the container\nor the label of the drug bears any design, statement, or logo that makes any\nfalse or misleading claims.<\/li><\/ol>\n\n\n\n<p>Further, the definition of<em> <\/em><strong><em>Misbranded Cosmetics<\/em><\/strong> is given under <strong><em>Section 17C of the Act<\/em><\/strong><em>.<\/em> As per this definition, a Cosmetic will be considered as Misbranded in the situation as follows:<\/p>\n\n\n\n<ol><li>If the product\ncontains unspecified color;<\/li><li>If it is not\nlabeled properly;<\/li><li>If the label or\ncontainer of the product bears any logo or design, which makes any misleading\nor false claims.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_Adulterated_Drugs_or_Cosmetics\"><\/span>Concept of Adulterated Drugs or Cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The definition of <strong><em>Adulterated Drugs<\/em><\/strong> is given under <strong><em>section 17 A of the Drugs and Cosmetics Act, 1940<\/em><\/strong>. As per this definition, a Drug will be considered as Adulterated in the situations as follows:<\/p>\n\n\n\n<ol><li>If the product\ncontains any putrid, filthy or decomposed substance, whether in whole or in\npart;<\/li><li>If the drug has\nbeen packaged, prepared, or stored under insanitary or unhygienic conditions,\nwhereby it maybe got contaminated with filth or have been rendered injurious\nand harmful to health;<\/li><li>If the container\nof the product is made of any deleterious or poisonous substance which may render\nthe components injurious to health;<\/li><li>If for color,\nthe drug contains any color other than the one prescribed;<\/li><li>If the product\ncontains any toxic or harmful ingredient which may render it injurious to\nhealth;<\/li><li>&nbsp;If the product includes any substance, which\nthereby reduces its strength or quality. <\/li><\/ol>\n\n\n\n<p>Further, the definition of <em><strong>Adulterated Cosmetic<\/strong><\/em> is given under <strong><em>section 17 E of the Act.<\/em><\/strong> According to the definition, a drug will be considered as Adulterated in the following situations:<\/p>\n\n\n\n<ol><li>If the product\ncontains any putrid, filthy or decomposed component;<\/li><li>If the product\nhas been packed, prepared or stored under unhygienic conditions;<\/li><li>If the cosmetic comprises\nof any poisonous or deleterious substance;<\/li><li>If the product\ncontains any color other than&nbsp; the\nprescribed one;<\/li><li>If the item\nincludes any toxic or harmful component, which is injurious to health;<\/li><li>If the product\ncontains any substance which thereby reduces its strength or quality.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_Spurious_Drugs_or_Cosmetics\"><\/span>Concept of Spurious Drugs or Cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The definition of <em><strong>spurious drugs<\/strong><\/em> or <em><strong>cosmetics<\/strong><\/em> is given under <strong><em>sections 17 B and 17 D of the Act<\/em><\/strong>, respectively. The situations in which the manufacture, sale and distribution of drugs or cosmetics become spurious are as follows: <\/p>\n\n\n\n<ol><li>If a drug or\ncosmetic is prepared under a name which belongs to another cosmetic or drug;<\/li><li>If the product\nis imitation or substitute of an already existing cosmetic or drug;<\/li><li>The label or the\ncontainer of the product bears a fictitious name. The term \u201cfictitious\u201d denotes\ncompany name which does not exist;<\/li><li>If the product\nhas been substituted by another drug or cosmetic;<\/li><li>If it claims to\nbe the product of a manufacturer of whom it is not really a product.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_Patent_or_Proprietary_Medicine\"><\/span>Concept of Patent or Proprietary Medicine<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The term \u201c<em><strong>Patent or Proprietary Medicine<\/strong><\/em>\u201d means a drug, which is a prescription or remedies for human beings. However, the said drug has not received recognition from the WHO or the authorities working on behalf of the Central Government. <\/p>\n\n\n\n<p>Therefore, the manufacture, sale and distribution of\ndrugs of such type have been restricted by the government.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_Counterfeit_Drugs_or_Cosmetics\"><\/span>Concept of Counterfeit Drugs or Cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The <em><strong>WHO (World Health Organisation)<\/strong><\/em> defines <strong><em>\u201cCounterfeit Drugs or Cosmetics\u201d<\/em><\/strong> as the product which has been <strong><em>fraudulently and dishonestly<\/em><\/strong> mislabeled regarding its identity or history of the source. Further, it clarifies that both branded and generic products are included in Counterfeit Drugs or Medicines. <\/p>\n\n\n\n<p><strong>Furthermore, this definition also includes the following listed:<\/strong><\/p>\n\n\n\n<ol><li>Product with\ncorrect ingredients;<\/li><li>Product with\nwrong ingredients;<\/li><li>Drugs and\nCosmetics without active ingredients;<\/li><li>&nbsp;Drugs and Cosmetics with too many active or\ninsufficient ingredients.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Prohibition_on_the_Manufacture_Sale_and_Distribution_of_Drugs_and_Cosmetics\"><\/span>Prohibition on the Manufacture, Sale and Distribution of\nDrugs and Cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per <strong><em>section 18 of the Act<\/em><\/strong>, the situations relating to the prohibition on the manufacture, sale and distribution of Drugs and Cosmetics are as follows: <\/p>\n\n\n\n<ol><li>When the <em>drug is of Sub-standard Quality, Misbranded, Spurious or Adulterated;<\/em><\/li><li>When the cosmetic is of Sub-standard Quality, Misbranded, Spurious or Adulterated;<\/li><li>If the drug belongs to the category of Patent or Proprietary Medicine;<\/li><li>If a drug purports or claims to prevent, cure or mitigate, any disease or ailment;<\/li><li>When a drug or cosmetic is manufactured in contravention to the stipulations prescribed;<\/li><li>When a cosmetic comprises of harmful and unsafe ingredient;<\/li><li>\u00a0Sale and Distribution of any product manufactured in contravention of the Act;<\/li><li>Stock or exhibit any drug or cosmetic which has been prepared or imported in violation of the Act.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Exceptions_to_Section_18_of_the_Drugs_and_Cosmetics_Act\"><\/span>Exceptions to Section 18 of the Drugs and Cosmetics Act<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The exceptions to <strong><em>section 18 of the Drugs Act<\/em><\/strong> are as follows:<\/p>\n\n\n\n<ol><li>The provisions\nof this section do not apply to the manufacture of drugs in small quantities.\nHowever, such manufacturing must relate to analysis, test or examination of the\ndrug, subject to the prescribed conditions;<\/li><li>The Central\nGovernment, together with the Drugs Technical Advisory Board, can allow the\nmanufacture, sale and distribution of drugs or cosmetics of sub-standard\nquality.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Disclosure_of_the_Premises\"><\/span>Disclosure of the Premises <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>As per <strong><em>section 24 of the Act,<\/em><\/strong> every manufacturer, seller, or distributor of drugs or cosmetics need to make a complete disclosure of the place or premise of manufacture or maintenance of the drug or cosmetic to the concerned inspector.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Punishment_for_the_Manufacture_Sale_and_Distribution_of_Drugs_in_Contravention_to_the_Act\"><\/span>Punishment for the Manufacture, Sale and Distribution of\nDrugs in Contravention to the Act<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p><em>The penal provisions for the Manufacture, Sale and Distribution of Drugs in contravention to the Drug and Cosmetic Act are as follows: <\/em><\/p>\n\n\n\n<ol><li>The manufacturer of the drug that falls under <em><strong>Section 17A or 17B<\/strong><\/em> and causes death or grievous hurt of a person will be punished with a fine not less than <em><strong>Rs 10 lakhs or 3 times the value of the drug confiscated<\/strong><\/em>. <\/li><\/ol>\n\n\n\n<p>Further, the manufacturer will also be liable to <strong><em>imprisonment for a term of ten years<\/em><\/strong>. It can also extend to <strong>life imprisonment.<\/strong><\/p>\n\n\n\n<p>The person convicted will also be liable to pay\ncompensation to the victim or the person who had consumed such an adulterated\ndrug. However, in the case of death, the manufacturer needs to pay compensation\nto the family of the deceased person.<\/p>\n\n\n\n<ul><li>In case a drug falls under <strong><em>section 17A of the Act<\/em><\/strong> [other than the one mentioned in point (a)] and is being used without a valid license, then the manufacturer will be liable to pay a <strong><em>fine of Rs 1 lakhs or 3 times the value of the drug confiscated<\/em><\/strong>. He\/she will also be liable for the <strong><em>imprisonment of a term of three years,<\/em><\/strong> which may extend to <strong><em>five years.<\/em><\/strong><\/li><li>&nbsp;The manufacturer of the drug that under<em><strong> section 17B of the Act <\/strong><\/em>[other than the one mentioned in point (a)] will be liable to pay a <strong><em>fine of Rs 3 lakhs or 3 times the value of the drug confiscated<\/em><\/strong>. He\/she will also be liable for the <em><strong>imprisonment of a term of seven years<\/strong><\/em>, which may extend to <strong><em>life imprisonment.<\/em><\/strong><\/li><li>The manufacturer of a drug other than the one mentioned in point (a), (b), and (c), works in contravention of the provisions of the Act, will be liable to pay a fine not<strong><em> less than Rs 20,000<\/em><\/strong>. He\/she will also be liable for an <em><strong>imprisonment of one year<\/strong><\/em>, which may extend to <strong><em>two years.<\/em><\/strong><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Punishment_for_the_Manufacture_Sale_and_Distribution_of_Cosmetics_in_Contravention_to_the_Act\"><\/span>Punishment for the Manufacture, Sale and Distribution of\nCosmetics in Contravention to the Act<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ol><li>The manufacturer of a cosmetic that falls under <em><strong>section 17D or 17E of the Act <\/strong><\/em>will be punishable with a fine not less than <strong><em>Rs 50,000 or 3 times the value of the cosmetic confiscated<\/em><\/strong>.
