<\/p>\n\n\n\n<p>The main benefit of a TM Registration is that it facilitates differentiation between the goods of the registered owner with other available in the market.<\/p>\n\n\n\n<p>Therefore, Trademark registration provides the owner with the authority to maintain the individuality and uniqueness of his\/her goods and services. In the case of Trademark Infringement, it allows the owner with the power to sue the third person as well.<\/p>\n\n\n\n<p>Further, the symbol \u201cR\u201d will apply to the concerned good or service after successful Trademark Registration. These classes are based on the classes specified by the NICE Classifications. Further, in total, there are 45 trademark classifications available, out of which 34 classes are known as TM Classes for Goods, and the remaining 11 are termed as TM Classes for Services.<\/p>\n\n\n\n<p>At present, there are around 8000 products and services covered under the ambit of Trademark Classifications.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Significance_of_Trademark_Classes\"><\/span>Significance of Trademark Classes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong><em>significance of Trademark Classes<\/em><\/strong>\ncan be summarised as:<\/p>\n\n\n\n<ol><li>Provides\nGuideline for Registering Trademarks in India;<\/li><li>Helps in\nIdentifying the Trademark Infringers in India;<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_Trademark_Search_in_India\"><\/span>Concept of Trademark Search in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The procedure for determining a correct Trademark Class for obtaining TM Registration is known as Trademark Search or Trademark Public Search. Further, for doing the TM Search, an applicant can use the Indian Trademark Registry Database (ITRD). <\/p>\n\n\n\n<p>The main purpose of TM Public Search is to ascertain whether a specific goods or service falls under the ambit of Trademark Classification or not.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_Trademark_Description\"><\/span>Concept of Trademark Description<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The term \u201cTrademark Description\u201d denotes the general indications appearing on different class of goods and services. It basically depicts the field from which a product or service belongs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_NICE_Classification\"><\/span>Concept of NICE Classification<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The term \u201cNICE Classifications\u201d denotes a mechanism on which the trademark classes are based on. It was formed on 15.06.1957, by way of an agreement signed at the NICE Diplomatic Conference. However, the said classification was revised in the year 1967 at the Stockholm Conference and again in 1977 at the Geneva Conference.<\/p>\n\n\n\n<p>Further, India signed the NICE Agreement on 07.09.2019, i.e., the ITO (Indian Trademark Office) are using the updated version for the classification of goods and services.<\/p>\n\n\n\n<p>Furthermore, the NICE Classification provides a broad heading named as \u201cClass Header\u201d. A class header gives a clear explanation about the goods and services covered under each class.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Tools_Available_for_Trademark_Classification\"><\/span>Tools Available for Trademark Classification<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The different tools available for Trademark\nClassification are as follows:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"NICE_Classification\"><\/span>NICE Classification<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>This Tool was provided by the <em>World Intellectual Property Organisation<\/em> (WIPO);<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"TM_Classification\"><\/span>TM Classification<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>This Tool was provided by the <strong><em>European Union Intellectual\nProperty Office<\/em><\/strong> (EUIPO);<\/p>\n\n\n\n<p>Further, in our opinion, TM Classification is a better tool than NICE Classification. Further, one can also apply the Trademark\nRegistration for both goods and services. <\/p>\n\n\n\n<p>For Example, Starbucks has a registered trademark\nfor both its products and services. The reason for the same is that it not only\noffers a variety of coffees but sells ground coffee, branded coffee beans,\ncoffee mugs as well.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Select_a_Valid_Trademark_Class\"><\/span>Select a Valid Trademark Class<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In the next step, the applicant needs to choose a\nvalid Trade Mark Class from the classification of the finalized Goods and\nServices.<\/p>\n\n\n\n<p>If in case the functions of a good or service are\nnot provided in the class heading of the Trademark Classes. The applicant can\nchoose the class based on the description of the said good or service.<\/p>\n\n\n\n<p>Further, an applicant can file a Trademark\nApplication only for a single class of goods or services. That means the\napplicant needs to file multiple trademark applications if in case he\/she wants\nto register a trademark in more than one classification.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conduct_Trademark_Search\"><\/span>Conduct Trademark Search<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In the last step, the applicant needs to conduct the\nprocess of trademark search based on the nature of the goods and services and\nnot on the basis of components.<\/p>\n\n\n\n<p>However, this process needs professional assistance,\nbecause in case the applicant chooses a wrong step, he\/she will need to start\nthe process of classification again.<\/p>\n\n\n\n<p><strong><em>For example<\/em><\/strong>, in case an applicant searches for Photography, then Chemicals under Class 1, Computer and Scientific Devices under Class 9, and Education and Entertainment Services under Class 31 are represented as relevant. Therefore, there is a need for an applicant to consult IPR experts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Basics_for_the_Trademark_Classification_of_Goods\"><\/span>Basics for the Trademark Classification of Goods<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong><em>things to consider<\/em><\/strong> for the <strong><em>Trademark\nClassification of Goods<\/em><\/strong> are as follows:<\/p>\n\n\n\n<ol><li>Normally, a\nproduct is categorized based on its usage and functions. However, if in case\nthe usage or functions of a good are not specified by any class, the owner will\nclassify the product based on the similarities with other finished goods\navailable in the alphabetical list.<\/li><li>If in case the\napplicant is not able to find any similarity, he\/she can categorize the product\nbased on the mode of operation or material used as the Subsidiary Criteria.<\/li><li>In case a good\nserve multiple objectives, the same will be categorised in all the classes\nrelating to its functions. However, if in case the functions are not explicitly\nmentioned, the criteria mentioned in (b) will be used.<\/li><li>All the Raw\nMaterials, whether unworked or semi-worked, are classified based on their\ncomponents.<\/li><li>In case a\nproduct intends to form part of some other product, the same is classified in\nthe class in which the product it intends to form a part is classified. <\/li><li>In case a\nproduct is a blend of several raw materials, the same will be classified\naccording to the predominating raw material.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Basics_for_the_Trademark_Classification_of_Services\"><\/span>Basics for the Trademark Classification of Services<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong><em>things to consider<\/em><\/strong> for the <strong><em>Trademark\nClassification of Services<\/em><\/strong> are as follows:<\/p>\n\n\n\n<ol><li>Normally, the\nservices are categorised based on the branches of activities specified in the\nHeading and Explanatory Notes of the Service Class. <\/li><li>If in case, the\nbranches of activities are not specified for a service, the same will be\nclassified based on the similarities with other services available in the\nalphabetical list.<\/li><li>Rental Services\nare categorised in the class in which the services offered using rental objects\nare classified.<\/li><li>Services that\ninclude consultation, advice, or providing information are classified in the\nclass, which resembles the subject matter of said consultation, advice, and\ninformation.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Consequences_of_Choosing_an_Incorrect_Trademark_Class\"><\/span>Consequences of Choosing an Incorrect Trademark Class<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong><em>consequences <\/em><\/strong>of <strong><em>choosing an Incorrect Trademark\nClass<\/em><\/strong> are as follows:<\/p>\n\n\n\n<ol><li>Authorities will\nreject the application for trademark registration;<\/li><li>No refund of the\nRegistration Fees;<\/li><li>The individual\nwill be infringing the rights of a registered trademark holder;<\/li><li>In case the\napplicant has obtained the trademark registration in the wrong class, he\/she\ncannot switch over to the correct class.
