etc., which is not only <em>unique in nature<\/em> but is eligible to <em>separate the product or service<\/em> of the manufacturer or service provider <em>from the competitors<\/em>, needs to be registered as a trademark.&nbsp; <\/p>\n\n\n\n<p>Further, it is accepted globally that a <em>registered trademark<\/em> acts as the <em>valuable asset<\/em> of the <em>business<\/em>. Moreover, with the <em>registered trademark<\/em>, a user can easily <em>distinguish<\/em> between the <em>goods of the competitors<\/em>.<\/p>\n\n\n\n<p>Also, a <em>registered trademark<\/em> remains <em>valid <\/em>for a period of <em>10 years<\/em> and is qualified for <em>Trademark Renewal<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Regulatory_Framework_for_Trademarks\"><\/span>Regulatory Framework for Trademarks<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In India, the <em>Controller General of Patents Designs and Trademarks (CGPDT) <\/em>works as the <em>Regulatory Authority<\/em> for Trademarks. However, the <em>Trademarks Act 1999<\/em> acts as the <em>Regulatory Law<\/em> for Trademarks.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Significance_of_Trademark_Registration\"><\/span>Significance of Trademark Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/swaritadvisors.com\/78091d09-c89a-4c0d-9fdb-637509701086\" alt=\"\"\/><\/figure>\n\n\n\n<p>In India, the <em><strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/swaritadvisors.com\/trademark-registration\">Trademark Registration<\/a><\/span><\/strong><\/em> is <em>mandatory<\/em> for the <em>reasons<\/em> as follows:<\/p>\n\n\n\n<ol><li>A registered\ntrademark acts as a valuable asset for any business;<\/li><li>Users or\nConsumers can easily differentiate between the products and services of two\ncompetitors;<\/li><li>Acts as the\nshield to protect the brand, logo, name, etc., from misuse, imitation, and\nduplication;<\/li><li>Secures the\nbusiness products and services of the Trademark Holder;<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Objectives_of_Trademark_Registration\"><\/span>Objectives of Trademark Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The main aim of the Trademark Registration is to <em>distinguish and separate<\/em> the <em>trademarks and service marks<\/em> concerning the <em>products and services<\/em> of certain fields. <\/p>\n\n\n\n<p>Therefore, it is suggested that every <em>manufacturer<\/em> and <em>service provider<\/em> apply for \u201c<em>Registration under Trademark<\/em>\u201d. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_Classification_under_Trademarks_Act_1999\"><\/span>Concept of Classification under Trademarks Act 1999<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The&nbsp;<em>categories<\/em> under which a \u2018<em>manufacturer\u2019<\/em> or a \u2018<em>service provider\u2019<\/em> can file for the<em> \u201cRegistration\u201d <\/em>are termed as&nbsp;<em>Classifications under Trademarks Act<\/em> or <em>Trademark Classes<\/em>.<\/p>\n\n\n\n<p>Moreover, these&nbsp;<em>classes <\/em>are defined based on the&nbsp;\u201c<em>segregation\u201d <\/em>prescribed in the&nbsp;<em>NICE Classification<\/em>.<\/p>\n\n\n\n<p>At present, there are&nbsp;in total <em>45 different Classes of Trademark <\/em>mentioned under the&nbsp;<em>Trademarks Act 1999. Further, the main aim of these indications<\/em>&nbsp;is to offer a <em>specific&nbsp;class<\/em> for each <em>product or service<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_Trademark_Search_in_India\"><\/span>Concept of Trademark Search in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>When an applicant decides
