Farmers are seen as feeding hands for the nation but it is saddening to see that these hands that feeds the nation in strangulated in starvation. Agriculture not only employs a large section of the population but also contributes in the growth of GDP by 15% of the country. In recent time, agitation and protest by the farmers can be seen at various parts of the country. These are because of the introduction of three new Farmer\u2019s Bill, 2020 which are <em>The <strong><span style=\"text-decoration: underline;\"><a href=\"https:\/\/swaritadvisors.com\/producer-company-registration\">Farmers Produce<\/a><\/span><\/strong>, Trade and Commerce (Promotion and Facilitation) Bill, 2020, The Farmers (Empowerment and Protection) Agreement of Price Assurance and Farm Bill Services, 2020 and The Essential Commodities (Amendment) Bill, 2020.<\/em> The Farmer\u2019s bill, 2020 was passed on 14<sup>th<\/sup> September, 2020 by the Union Minister Shri Narendra Singh Tomar in both the houses of the Parliament <a rel=\"noreferrer noopener\" href=\"https:\/\/pib.gov.in\/PressReleaseIframePage.aspx?PRID=1655890#:~:text=hard%20working%20farmers.-,The%20Farmers%20(Empowerment%20and%20Protection)%20Agreement%20of%20Price%20Assurance%20and,farm%20services%20and%20sale%20of\" Bill, 2020<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The concept of the bill is basically based on <strong>\u201c<\/strong>One India, One Agricultural Marke<strong>t\u201d<\/strong>. The Farmer\u2019s Bill, 2020 intents to regulate and create an environment where farmers and traders will enjoy their freedom of sale and purchase without any barrier. The bill aims to open the gates for the farmers to the corporate world for creating better trading opportunities which could extend beyond the APMC market yards. The government is of the opinion that the new laws related to the Farmer\u2019s Bill, 2020 provide farmers not only with more choice but also with the completion of better prices. But the opposition does not think so and considers this to be an Anti-Farmer\u2019s Bill.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Highlights_of_the_Farmers_Produce_Trade_and_Commerce_Promotion_and_Facilitation_Bill_2020\"><\/span>Key\nHighlights of the Farmer\u2019s Produce Trade and Commerce (Promotion and\nFacilitation) Bill, 2020<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pros\"><\/span>Pros<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>Farmers\ncan sell their agricultural produce at a place of their choice even beyond the\nAPMC market yards at a price better than the Mandi, thus increasing the number\nof potential buyers.<strong><\/strong><\/li><li>The\nbill enables that there will be no trade barrier for the farmers in order for\ncarrying out their business outside the physical boundaries of markets.<strong><\/strong><\/li><li>The\nbill proposes an electronic trading platform for the farmers to ensure seamless\ntrade electronically.<strong><\/strong><\/li><li>No cess\nor levy for the sale of agricultural produce to be paid.<strong><\/strong><\/li><li>The\nbill proposes a separate dispute resolution mechanism for the farmers for\nspeedy trial thus leading to avoidance of court litigation.<strong><\/strong><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cons\"><\/span>Cons<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>The opposition is of the view that there will be loss of revenue to the states if the farmers agree to sell their produce beyond the APMC market. \u201cMandis\u201d are supposed to bring revenue for the state government and this bill if came into effect would hamper and diminish their relevance.<\/li><li>Middle man will cease to exist as farmers will be able to sell their produce directly to the registered trader.<\/li><li>Farmers fear that the new bill will end the Minimum Support Price  <a rel=\"noreferrer noopener\" href=\"https:\/\/farmer.gov.in\/mspstatements.aspx\" target=\"_blank\"><strong>[2]<\/strong><\/a> (MSP) regime. \u201c<em>This new legislation has nothing to do with the MSPs, it is merely providing freedom of choice to sell and buy the produces outside the mandis\u201d, as stated by Agriculture Minister Narendra Singh Tomar<\/em><strong><em>.<\/em><\/strong><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Highlights_of_the_Farmers_Empowerment_and_Protection_Agreement_of_Price_Assurance_and_Farm_Services_Bill_2020\"><\/span>Key Highlights of the Farmer\u2019s\n(Empowerment and Protection) Agreement of Price Assurance and Farm Services\nBill, 2020<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pros-2\"><\/span>Pros<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>The bill facilitates the farmers to\nenter into a direct commercial agreement with the corporate producing food\nproducts, exporters, retailers etc. This would provide exposure to the global\nmarkets thus eliminating the fear of exploitation. <\/li><li>It encourages in creating a framework\nfor contract farming between a farmer and a buyer through a contract. This\ncould provide transparency and lucrative price framework to the farmers.<\/li><li>Agricultural produce or crops under\nany such agreement shall be exempted from the laws and provisions relating to\nthe Essential Commodities Act.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cons-2\"><\/span>Cons<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>The opposition is of a view that the\ncorporate will have an upper hand over the farmers as they have weak\nnegotiation skills.<\/li><li>The small farmers might be deprived of\nany such sponsors.<\/li><li>The bill gives independence to the\ncorporate instead of the farmers as MSP has not been mentioned anywhere in the\nbill.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Highlights_of_the_Essential_Commodities_Amendment_Farmers_Bill_2020\"><\/span>Key Highlights of the Essential Commodities (Amendment) Farmer\u2019s Bill, 2020<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pros-3\"><\/span>Pros<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>The Act empowers the Central\nGovernment to consider certain commodities (such as food items, fertilizers,\nand petroleum products) as essential commodities.<\/li><li>The bill proposes to enable the\nprivate investment in the agricultural sector.<\/li><li>Helps both the farmers as well as the\nconsumer to bring the price stability.<\/li><li>The bill seeks to increase the\ncompetition in the market thus providing better opportunities.<\/li><li>Removes fear of excessive regulatory\ninterference from the minds of the private players.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cons-3\"><\/span>Cons<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>The opposition is of the view point\nthat the freedom to stock commodities may lead to exploitation as big companies\nwill charge exorbitant prices.<\/li><li>The price limit set for the\n\u201cextraordinary circumstances\u201d are so high that it is likely never to be\ntriggered.<\/li><\/ul>\n\n\n\n<p><strong>Conclusion<\/strong><\/p>\n\n\n\n<p>The farmers are\nconsidered to be one of the most important pillars for growth in our country.\nThe Central Government by passing Farmer\u2019s Bill, 2020 in the favour of the\nfarmers has moved in the right direction for providing them the bigger platform\nto get the desired amount of their agricultural products.
