or Non-Governmental Organisation is a\nlegal unit formed by natural persons. It operates independently without any government\u2019s\ninterference and works towards the welfare of public and social agenda. <\/p>\n\n\n\n<p>Further, all the profits earned by an NGO are fully\nutilised towards its agenda and objectives. That means there will be no\ndistribution of dividend among members. <\/p>\n\n\n\n<p>Moreover, it shall be significant to state that an\nentity that has obtained either of the following registration will be termed as\nan NGO in India:<\/p>\n\n\n\n<ol><li>Trust Registration;<\/li><li><a href=\"https:\/\/swaritadvisors.com\/section-8-company-registration\" class=\"text-primary\"><strong>Section 8 Company Registration<\/strong><\/a>, or;<\/li><li>Society Registration;<\/li><\/ol>\n\n\n\n<p>Therefore, for obtaining Temple Registration in India,\nthe applicant needs to obtain registration under either of the modes mentioned\nabove.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concept_of_Temple_Registration_as_Trust\"><\/span>Concept of Temple Registration as Trust<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In India, the\nbasic prerequisite for obtaining Trust Registration is to draft a Trust Deed.\nThat means the individuals who are forming a Temple needs to first draft a\ntrust deed on a non-judicial stamp paper and then requires to visit the sub-registrar\noffice for its execution.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Required_for_Registering_a_Temple_as_Trust\"><\/span>Documents Required for Registering a Temple as Trust<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Documents required for Registering a Temple as a Trust\nare as follows:<\/p>\n\n\n\n<ol><li>Trust Deed;<\/li><li>Self-attested\ncopies of Id Proofs, in the form of Aadhar Card, Passport, Voter ID, Driving\nLicense, etc.;<\/li><li>PAN Card;<\/li><li>Address Proof of\nthe Place being used as Registered Office;<\/li><li>NOC (No Objection\nCertificate) from the owner;<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_for_Registering_a_Temple_as_Trust\"><\/span>Process for Registering a Temple<strong> as Trust<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"768\" src=\"https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/10\/Process-for-Registering-a-Temple-as-Trust-1024x768.png\" alt=\"Process for Registering a Temple\" class=\"wp-image-14583\" srcset=\"https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/10\/Process-for-Registering-a-Temple-as-Trust-1024x768.png 1024w, https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/10\/Process-for-Registering-a-Temple-as-Trust-300x225.png 300w, https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/10\/Process-for-Registering-a-Temple-as-Trust-768x576.png 768w, https:\/\/swaritadvisors.com\/learning\/wp-content\/uploads\/2020\/10\/Process-for-Registering-a-Temple-as-Trust.png 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure><\/div>\n\n\n\n<p>The steps involved in the process to obtain Trust\nRegistration from a Temple are as follows:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Choose_a_Name\"><\/span>Choose a Name<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In the first step, the members of a Trust needs to\nselect an appropriate name for the Trust. Further, the term \u201cAppropriate Name\u201d\ndenotes that the name chosen must be in accordance with the provisions of the\nEmblems and Names Act 1950.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Decide_the_Authors_and_Trustees\"><\/span>Decide the Authors and Trustees<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In the next step, there is a need to decide the number\nof authors and trustees. Usually, there is only one author of a Trust, but\nthere is no upper limit provided for the maximum number of trustees. Also, it\nshall be pertinent to mention that an author cannot become the trustee of a\nTrust, and he\/ she needs to mandatorily be a Resident of India.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Prepare_MOA_and_Trust_Deed\"><\/span><strong>Prepare MOA and\nTrust Deed<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Now, there is a\nneed for the members of a Trust to draft a Trust Deed, which will act as a\nLegal Evidence for the existence of a Trust. Further, all the laws concerning addition\nand removal of Trustees are covered under this document.<\/p>\n\n\n\n<p>Also, they need\nto prepare an MOA or Memorandum of Association, which will act as the Charter\nfor a Trust. Further, all the rules and regulations, duties, relationship,\nobligations, objectives, etc. are covered under this legal document.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Printing_of_Trust_Deed_on_Stamp_Paper\"><\/span><strong>Printing of Trust\nDeed on Stamp Paper<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>For obtaining Temple Registration, the applicant\nrequires to get the trust deed printed on a non-judicial stamp paper. Further,\nthe value of stamp paper must not exceed a certain percentage of the total\nvalue of the property.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Submission_of_Trust_Deed\"><\/span><strong>Submission of Trust\nDeed<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In this step, the applicant needs to submit a copy of\nthe Trust Deed, together with the attested copy the necessary documents at the\nlocal office of the Registrar. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Issuance_of_the_Certificate_of_Registration\"><\/span><strong>Issuance of the\nCertificate of Registration<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In the last step, after the submission of the Trust Deed, the registrar will preserve a photocopy of the same and will return the original deed.
