However, in case of a Trademark, a Trademark infringement suit&nbsp;may typically arise between your brand and another, as a result of one or more of the following circumstances \u2013&nbsp;<\/p>\n\n\n\n<ul><li>Two businesses are being run by using the same Trademark name or symbol.<\/li><li>The other party running the business with a registered Trademark files a complaint against the Trademark used by you.<\/li><li>The similarity between the two unregistered Trademarks is to be established by the owner of the registered Trademark.<\/li><li>The other party starts using the registered Trademark without even registering the mark.<\/li><li>The similarity to be established in context with colour, wrapping, tag lines, product designs, logo, brand name or any other such distinguishing factors.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Establishment_of_Similarities_in_a_Trademark\"><\/span>Establishment of Similarities in\na Trademark&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The concluding or the ultimate test which\nis done for the recognition of infringement of a Trademark is whether the\nreasonable buyer is eyeing at the goods or services is likely or most probably to\nconfuse between the two trademarks.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Illustration\"><\/span>Illustration<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The most prominent example which can\nbe laid down regarding the same is for the brand Parle G. Hence, the suit for the infringement of Trademark can be filed in such cases.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Causes_of_Action_Available_to_Trademark_Owners\"><\/span>Causes of Action Available to\nTrademark Owners<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any particular owners of a Trademark have two\ncauses of action available to them against the wrongful use of their marks by\nother traders: <\/p>\n\n\n\n<ul><li>Infringement,<\/li><li>Passing off <\/li><\/ul>\n\n\n\n<p>However, the right to sue for the infringement of Trademark arises from the violation of any such statutory right conferred by the <strong><a href=\"https:\/\/swaritadvisors.com\/trademark-registration\" class=\"text-primary\">process of trademark registration<\/a><\/strong> to use a trademark exclusively.<\/p>\n\n\n\n<p>Further, the right to sue in regards of passing off arises from deceit involving the use of a Trademark that is most likely to cause confusion or deception among the consumers thus leading to the passing off of goods of one for those of another.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Alternative_dispute_resolution\"><\/span>Alternative dispute resolution<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As explained under <strong>Section 89 of the Code of Civil Procedure 1908<\/strong><sup><a href=\"https:\/\/districts.ecourts.gov.in\/sites\/default\/files\/Section%2089%20CPC.pdf\" class=\"text-primary\"><strong><em>[1]<\/em><\/strong><\/a><\/sup>, the court may refer any specific dispute to arbitration, conciliation or for mediation where it seems to appear to the court that there exist some elements of a settlement which may be acceptable to the parties.<\/p>\n\n\n\n<p>There are many cases in relation to Trademark infringement and passing-off actions which are further referred to mediation. Following are some of the factors that the court will consider while deciding an interim injunction application:<\/p>\n\n\n\n<ul><li>Whether a&nbsp;prima Facie case has been made by the plaintiff.<\/li><li>The balance of convenience.<\/li><li>Irreparable harm to be suffered by the plaintiff in case if a temporary injunction is not granted.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Damages\"><\/span>Damages <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Plaintiffs can either claim damages or rendition of\naccounts. Further, before the filing of a lawsuit, it is deemed necessary for rights holders in respect to the Trademark to gather all the documents relevant to the case. These documents must be filed along with the complaint.<\/p>\n\n\n\n<p>Once the owner of the Trademark becomes aware of\ninfringement done by the third-party, it is not uncommon for them to engage\nindependent investigators to ascertain the nature and extent of the infringing\nactivities.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Survey_of_the_Evidence\"><\/span>Survey of the Evidence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Survey of the evidence is not considered as a popular\nmethod in order to prove the confusion and deception among the consumers. <\/p>\n\n\n\n<p>However, this process is considered to be of little value\nunless and otherwise the question asked and answers given are recorded, and\nthose who conducting the survey are being subjected to the cross-examination.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Defences_Available_in_case_of_Trademark_Infringement\"><\/span>Defences Available in case of Trademark\nInfringement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Invalid_registration\"><\/span>Invalid registration<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>As stated under section 31 of the Trademarks Act, the registration certificate is the only&nbsp;prima facie&nbsp;proof of the validity of the Trademark. This appeal can be made from the District Court to the High Court.<\/li><li>An appeal can be made against the order of a single judge of a High Court exercising ordinary original civil jurisdiction.
