discovery of living or non-living substances<\/li><li>a literary, dramatic, musical or artistic work or any other aesthetic creation<\/li><li>The invention which is an aggregation or duplication of filed at the address for service in India;<\/li><li>Place of business of his patent agent in India<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_File_a_Patent_Application\"><\/span>How to File a Patent Application?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li><strong>Patent Search:<\/strong> In order to ascertain the novelty of the invention, it is always advisable to do the <strong><a href=\"https:\/\/swaritadvisors.com\/patent-search\">patent search<\/a><\/strong> before filing an application.<\/li><li><strong>Filing of an Application:<\/strong> Application can be filed with a provisional or complete specification. If the application is filed with the provisional specification, application with complete specification has to be filed within 12 months from the date of filing of a <a href=\"https:\/\/swaritadvisors.com\/provisional-patent\" class=\"text-primary\"><strong>provisional patent application<\/strong><\/a><strong><em><br><\/em><\/strong><\/li><\/ul>\n\n\n\n<p>*Note: From 20th July 2007 the patent application can be filed through an online portal<a rel=\"nofollow noopener noreferrer\" href=\"https:\/\/ipindiaonline.gov.in\/epatentfiling\/goForLogin\/doLogin\" target=\"_blank\">.<\/a><\/p>\n\n\n\n<ul><li><strong>Publication of Application:<\/strong> Within a period of 18 months from the date of filing of the application, &nbsp;the application will be published in an official journal for the public to raise objections, if any<\/li><li><strong>Examination of Patent Application:<\/strong> Now, the patent examiner will examine the application only when the request for the examination has been generated by the applicant within 48 months from the date of application. The response to the examination report marked by the objections issued to be filed within 12 months.
