\u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In the entire Income Tax Act, a &#8220;partnership firm&#8221; is not defined anywhere. However, according to section 2(23) (iii) of the Income Tax Act, 1961, the word &#8220;partnership&#8221; has the same meaning as described in the Indian Partnership Act, 1932. A Partnership also includes a limited liability partnership as defined in the Limited Liability Partnership Act, 2008.<\/p>\n\n\n\n<p>In India, Partnership is one of the most common forms of business organization. &nbsp;It&#8217;s a type of business entity which is created by two or more persons who have agreed to share the profits and losses.<\/p>\n\n\n\n<p>As per the Income Tax Act,<\/p>\n\n\n\n<div class=\"shadow3\">&#8220;firm&#8221; shall have the meaning assigned to it in the Indian Partnership Act, 1932, and shall include a limited liability partnership as defined in the Limited Liability Partnersgip Act, 2008;<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Applicability_of_Provision_of_Income_Tax_Act_on_Partnership_Firm\"><\/span>Applicability of Provision of Income Tax Act on Partnership Firm \u00a0<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As already stated above, every partnership firm is liable for taxation under the Income Tax Act, 1961. Under Income Tax there are certain provisions which are applicable to a partnership firm.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_list_of_those_provisions_is_given_below\"><\/span>The list of those provisions is given below:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul><li>Section 40(ba) &#8211; Disallowance of salary and interest to a partner of the partnership<\/li><li>Section 67 &#8211; Method of Computing partner&#8217;s share in the income of the firm.<\/li><li>Section 67A &#8211; Method of Computing a member&#8217;s share in the income of an association of persons or body of individuals.<\/li><li>Section 86 &#8211; Taxability of Partner&#8217;s share of income.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Tax_Slab_rate_for_Assessment_year_2019-2020_for_Partnership_Firm\"><\/span>Tax Slab rate for Assessment year 2019-2020 for Partnership Firm <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The income tax rate varies from year&nbsp; to year, however, &nbsp;below tax slab rate is applicable on partnership firm&nbsp; for Assessment year 2019-2020:<\/p>\n\n\n\n<table class=\"wp-block-table table\"><tbody><tr><td><strong>Tax rate <\/strong><\/td><td><strong>Surcharge<\/strong><\/td><td><strong>Health and Education Cess<\/strong><\/td><\/tr><tr><td>30%<\/td><td>12%<\/td><td>4%<\/td><\/tr><\/tbody><\/table>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conditions_for_assessment_of_Partnership_Firm_to_be_assessed_as_PFAS\"><\/span>Conditions for assessment of Partnership Firm to be assessed as (PFAS) <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per rules and regulations of the Income Tax Act, 1961, an<strong> <\/strong><a class=\"text-primary\" href=\"https:\/\/swaritadvisors.com\/learning\/tag\/opt-for-partnership-firm\/\"><strong>online partnership firm<\/strong><\/a> may be assessed as&nbsp; (PFAS), if the partnership satisfies the following requirements:<\/p>\n\n\n\n<ul><li>The firm must be evidenced by an instrument ( written partnership deed);<\/li><li>The share of every partner must be specified in the partnership deed;<\/li><li>Every member have to certify the partnership deed;<\/li><li>A certified copy of the partnership deed must be filed along with the return of income;<\/li><li>There shall be no failure no part of the firm to comply with a notice given for assessment.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Assessment_of_Partnership_firm_In_India\"><\/span>Assessment of Partnership firm In India <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In case of partnership firm, interest, Salary bonus, and remuneration given to partners <u>are<\/u> deductible under the Income Tax Act, 1961.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Assessment_of_Interest_paid_to_partners\"><\/span>Assessment of Interest paid to partners <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If any firm pays interest to any partner, then the firm can claim the deduction of interest at a rate of 12% per annum. Interest paid in excess of the rate as discussed must be disallowed in hands of the firm.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Remuneration_is_given_to_Partners\"><\/span>Remuneration is given to Partners <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>According to <strong>section 40 (b) of Income Tax Act<sup><a class=\"text-primary\" href=\"https:\/\/www.incometaxindia.gov.in\/Pages\/acts\/income-tax-act.aspx\"><strong><em>[1]<\/em><\/strong><\/a><\/sup> <\/strong>, any salary, bonus, remuneration given to any partner will be allowed as deduction. However, for the deduction,\u00a0 the firm needs to fulfil the following conditions :<\/p>\n\n\n\n<ol><li>Payment of remuneration made to a working partner.<\/li><li>Payment of remuneration is made as per terms of partnership deed.<\/li><li>Payment relates to a period that falls after the date of partnership deed.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Assessment_of_Partners\"><\/span>Assessment of Partners <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Interest amount, remuneration received by a partner shall be taxed in the hands of partner as &#8220;business or professional income&#8221;.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Assessment_of_Losses_of_the_Partnership_Firm\"><\/span>Assessment of Losses of the Partnership Firm<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Loss, unabsorbed loss of the firm for the assessment year 1993-93 shall not be apportioned amongst the partners. Only the Firm will carry forward the loss.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Due_date_of_filing_a_tax_return_for_partnership_firm\"><\/span>Due date of filing a tax return for partnership firm <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>As per Provisions of the Income Tax Act, every partnership firm before July 31 of the assessment year requires to file an income tax return.<\/p>\n\n\n\n<p>Where the partnership firm does not audit its account, then the firm requires to file an <strong><a href=\"https:\/\/swaritadvisors.com\/income-tax-return-filing\" class=\"text-primary\">income tax return<\/a><\/strong> before 30th September.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Partnership firm isn&#8217;t defined under the Income Tax Act.
