objection against it on one or several grounds. <\/p>\n\n\n\n<p>Therefore, before you apply for <strong><a class=\"text-primary\" href=\"https:\/\/swaritadvisors.com\/trademark-registration\">trademark registration<\/a><\/strong>, you must ensure that your application is complete and that you have filed your application class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Trademark\nObjection is the preliminary stage in the trademark (TM) registration process\nwhere the trademark examiner raises an objection against the trademark\napplication due to a number of reasons. <\/p>\n\n\n\n<p>The\napplicant gets an opportunity to prove how his\/her Trademark fits the criteria\nfor availing the valid registration. It is called the trademark objection\nreply.<\/p>\n\n\n\n<p>Mainly,\nthere are two crucial reasons on which the trademark examiner objects to the\napplication. They are- a) either the applicant is incomplete or contains wrong\ninformation, or b) similar Trademark exists.<\/p>\n\n\n\n<p>However,\nthere are multiple other grounds on which an objection is raised. We have\ndescribed all of them later in this blog. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Various_Reasons_for_Trademark_Objection_in_India\"><\/span>Various\nReasons for Trademark Objection in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If\nthe applicant violates any of the Trade Marks Rules, then the examiner holds\nthe complete authority to object to the filed application through an\nexamination report. <\/p>\n\n\n\n<p>A <strong><a href=\"https:\/\/swaritadvisors.com\/trademark-objection\" class=\"text-primary\">Trademark objection in India<\/a><\/strong> could take place due to the various reasons as follows:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Incorrect_Name_of_the_Trademark_Applicant\"><\/span>Incorrect Name of the Trademark Applicant <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\ntrademark applicant must mention his name correctly in the TM application. In\ncase he hasn\u2019t done so, the trademark examiner will raise an objection to his\napplication. <\/p>\n\n\n\n<p>One\ncan reply to the objection or overcome it by filing a trademark form TM-16.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Incorrect_Address_on_the_Trademark_Application\"><\/span>Incorrect Address on the Trademark Application <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If\nthe applicant mentions the incorrect address of the principal place of\nbusiness, or if he doesn\u2019t mention the address, then the examiner will raise\nthe objection against it. <\/p>\n\n\n\n<p>The\napplicant can correct this objection by filing a request in the TM-16 form. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Failure_in_filing_Trademark_Form_TM-48\"><\/span>Failure in filing Trademark Form TM-48<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If\nthe Trademark Attorney or Trademark Agent file the trademark application on\nbehalf of the applicant, then the applicant must attach the TM-48 form. In the\ncase, the trademark registry doesn&#8217;t find form TM-48 attached, or if it is\nincorrectly executed, then the examiner could raise the objection.<\/p>\n\n\n\n<p>Hence,\nif the applicant wants to rectify the objection, he\/she needs to file form\nTM-16. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Filing_of_Incorrect_Trademark_Form\"><\/span>Filing of Incorrect Trademark Form<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If\nyou have not made the trademark application on the appropriate form, then the\nTM examiner holds the authority to object to the filed application. Moreover,\nthe objection will read as follows:<\/p>\n\n\n\n<p>\u201cThe\napplication is made on TM-1 form, for certification mark in respect of goods or\nservices falling in a class, the form of the application should be corrected as\nTM-4 by filing a request on form TM-16.\u201d<\/p>\n\n\n\n<p>Hence,\nthe applicant needs to overcome this objection by filing a correct trademark\nform by making a request on form TM-16. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trademark_filing_under_the_Wrong_Trademark_Class\"><\/span>Trademark filing under the Wrong Trademark Class<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>One of the most important things to consider while filing a trademark application is to choose the right trademark class. However, if you have chosen the wrong trademark class, then your application will get rejected. Further, the status of your trademark class will stand as &#8216;Objected.&#8217;<\/p>\n\n\n\n<p>Therefore,\nyou must verify that the trademark class you have chosen is correct. If you are\napplying for a Trademark for your services, then you must choose the service\nclass, i.e., from 35 to 45. However, if you want a trademark class for goods,\nthen you must choose from trademark class 1 to 34.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_proposed_Trademark_already_exists\"><\/span>The proposed Trademark already exists<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>If\nthe proposed Trademark already exists, then the TM officer will not approve it\nand raise the objection.<\/p>\n\n\n\n<p>In\nsuch cases, the applicant needs to submit a reply to the trademark examination\nreport. In the response, he must state that the cited Trademark as a\nconflicting mark in the examination report is entirely different from the\napplicant&#8217;s Trademark.<\/p>\n\n\n\n<p>Furthermore,\nthe applicant must provide supporting evidence to the same. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trademark_lacks_distinctive_character\"><\/span>Trademark lacks distinctive character<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\nproposed Trademark must distinguish the products or services of one person from\nthose of the others. In case it contradicts with another person&#8217;s, then his\napplication will stand objected. Hence, your Trademark lacks distinctive\ncharacter.<\/p>\n\n\n\n<p>In\norder to rectify this objection under absolute grounds for refusal, the\napplicant has to submit evidence regarding the mark that it consists of a\ndistinctive character by virtue of its proper use. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Vague_specifications_of_Goods_and_Services\"><\/span>Vague specifications of Goods and Services <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>At\nthe time of the trademark application filing, one needs to be very specific.\nHowever, in the case you have specified the goods and services casually, which\ncontains a huge variety of the same, then the TM examiner will raise the\nobjection against the same. <\/p>\n\n\n\n<p>To\novercome this objection, the applicant must file TM-16 and request for a change\nin the original form.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Deceptive_Trademark\"><\/span>Deceptive Trademark <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\ntrademark examiner can raise an objection against the Trademark if the latter\nfounds that the proposed Trademark is deceiving the public by any means such as\nthrough its nature, use, quality or geographical origin of the products or\nservices.<\/p>\n\n\n\n<p>One\ncan overcome the objection of the deceptive Trademark by filing TM-16 Form. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"User_Affidavit_not_Attached\"><\/span>User Affidavit not Attached<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>A\nUser Affidavit is a crucial document that a trademark applicant needs to submit\nto the Trademark Registry.
