As per the Act, every promoter who wishes to market, sell, advertise, book, or purchase real estate project in Maharashtra is first required to obtain RERA Registration in Maharashtra.<\/p>\n\n\n\n<p>The promoters and real estate agents can register their real estate projects with the Department of Maharashtra Real Estate Regulatory Authority. Hence, for the same, they have to file an application with the respective authority along with the required documents. Furthermore, they must ensure\nthat even the small projects of local promoters are brought under the ambit of\nthe RERA Act. <\/li><li>Every on-going project\nthat hasn\u2019t obtained completion certificates is also required to get\nregistration under RERA with the Regulator within three months.<\/li><li>Real estate agents\nfacilitating purchase and selling of properties are required to obtain prior\nRERA registration under specific state laws. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_required_for_RERA_Registration_in_Maharashtra_from_Promoters_Developers_for_an_on-going_project\"><\/span>Documents\nrequired for RERA Registration in Maharashtra from Promoters &amp; Developers\n(for an on-going project) <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>For\nRERA registration in Maharashtra, firstly, the promoters or builders are\nrequired to submit the following documents: <\/p>\n\n\n\n<ul><li>PAN Card of the\npromoter;<\/li><li>Particulars of\nRegistration including bye-laws;<\/li><li>Memorandum of\nAssociation;<\/li><li>Articles of\nAssociation;<\/li><li>Self-certified copies\nof all letterheads;<\/li><li>Declaration or Income\nTax Returns details of the last three years;<\/li><li>Self-certified copy of\nletterhead rubber stamp;<\/li><li>Acknowledgment receipts\nto be used by the real estate agent;<\/li><li>Promoter\u2019s audited\nbalance sheet for the preceding financial year;<\/li><li>In case the promoter\nisn\u2019t the landowner on which the project development is proposed, then\nfollowing documents from the owner of the land is mandatory:<\/li><\/ul>\n\n\n\n<p>a)&nbsp;&nbsp;&nbsp; Consent;<\/p>\n\n\n\n<p>b)&nbsp;&nbsp;&nbsp; Development agreement;<\/p>\n\n\n\n<p>c)&nbsp;&nbsp;&nbsp; Joint development agreement;<\/p>\n\n\n\n<p>d)&nbsp;&nbsp;&nbsp; Collaboration agreement;<\/p>\n\n\n\n<p>e)&nbsp;&nbsp;&nbsp; Any other agreement between the promoter\nand owner. <\/p>\n\n\n\n<ul><li>Name, address, contact details, and a photograph of the promoter\/director\/partners\/chairman or any other authorized person if there\u2019s any other entity;<\/li><li>Details of Architecture and design standards, type of technology used in construction, earthquake-resistant measures, etc.<\/li><li>Layout plan of the real estate project;<\/li><li>Details regarding the encumbrances regarding the proposed land where the real estate project needs to be undertaken;<\/li><li>Details about the proceedings that are sub-judice in respect of the proposed land for real estate project (if any); regulations, as the\ncase may be;<\/li><li>Authenticated copy of\nMemorandum of Association (MoA), Articles of Association (AoA), Partnership\nDeeds, etc.<\/li><li>Particulars of the\nagent&#8217;s enterprise which must include its name, type of enterprise\n(partnership, proprietorship firm, company, etc.), registered address of the\nbusiness, PAN, Registration numbers, DIN, Aadhaar card number, etc. under which\nreturns are filed with the statutory authority;<\/li><li>Agent&#8217;s recent color\nphotographs, whether it&#8217;s an individual or partners, directors, trustees, etc.\nFurthermore, it also includes persons in service, etc. with real estate agents;<\/li><li>Details of Income Tax\nReturns for the last three fiscal years preceding the application;<\/li><li>In case the applicant\nis exempted from filing such returns in any of the three years, the entity must\nsubmit the declaration to such effect;<\/li><li>Particulars of all\ncriminal or civil cases pending against the agent;<\/li><li>Details regarding the\nreal estate projects and their promoters (if any) on behalf of whose the\napplicant is acting as a real estate agent in the preceding five years;<\/li><li>Authenticated copies of\nall rubber stamp images, letterheads, and acknowledgment receipts proposed that\nreal estate agent would be using;<\/li><li>Other such documents\nand information, as may be specified by regulations. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"RERA_Registration_Fees_in_Maharashtra_for_Real_Estate_Developers\"><\/span>RERA\nRegistration Fees in Maharashtra for Real Estate Developers <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nregistration fees differ for a different entity seeking RERA registration in\nMaharashtra. Here, we have presented fees for each of them:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"a_Registration_Fee_for_Real_Estate_Projects\"><\/span>a) Registration Fee for Real Estate Projects<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The fee for RERA registration in Maharashtra for real estate projects is a minimum of Rs. 50, 000 or Rs. 10 per square meter. However, the maximum fee lays up to Rs. 10, 00,000 only.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"c_Withdrawing_application_fee_for_the_registration_of_the_project\"><\/span>c) Withdrawing application fee for the registration of the project<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The\nfee for withdrawing the application for real estate project registration lies\nto the extent as stated by the regulations framed by the authority. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Maharashtra_RERA_Registration_Fee_for_Real_Estate_Agents\"><\/span>Maharashtra\nRERA Registration Fee for Real Estate Agents<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Real\nestate agents could either apply for fresh registration or for renewal of the\nregistration.
