It ensures the availability of wholesome and safe food\nfor human consumption.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Ministry of Health and Family\nWelfare along with Government of India has enforced FSS Act for the\nprogression of Food sector. Food Safety and Standards Act has\nrevolutionized the safety standards and manufacturing processes of\nfood in the nation. There is a constant evolution\nof food standards due to the advancements in food consumption\npatterns, science, preservatives, additives that gives rise to new\nrisks.&nbsp;<\/p>\n\n\n\n<p>Several Regulatory bodies and Acts\ndrove food safety before 2006. The main shortfall was a lack of or\nuniformity and standardization among those bodies. Therefore, it\nbecomes imperative to bring all the Regulatory Authorities under one\nroof and make a single food security body to effective regulation. \n<\/p>\n\n\n\n<p>Besides, numerous departments were\nresponsible for efficient administration that created troublesome\nsituations. It incurred the need for a single reference point in\nregards to the enforcement of Food Safety Standards.&nbsp;<\/p>\n\n\n\n<p>The new FSS Act 2006 was established\nwith the amalgamation of seven older Acts. It becomes a game-changer\nas it integrates international food standards.<\/p>\n\n\n\n<p>With the emergence of the new FSS Act, all food business operators are required to procure <strong><a href=\"https:\/\/swaritadvisors.com\/fssai-license\">FSSAI License<\/a><\/strong>. Moreover, the existing operators also have to re-register under the new Food Safety Standards, 2006 that were earlier licensed with the previous food laws.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Food_Business_Operators_that_must_obtain_FSSAI_License\"><\/span>Food Business Operators that must obtain FSSAI\nLicense<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to the latest regulations\nof FSS Act, any individual who runs a food business must acquire 14\ndigits FSSAI License number. The Authority has segregated Food\nLicense into three parts depending upon the scale of operations such\nas: \n<\/p>\n\n\n\n<ul><li><strong>FSSAI\n\tCentral License<\/strong>&#8211; A food business which has a turnover of more\n\tthan INR 20 crore per annum needs to attain Central License. The\n\tfood business operators that want to trade globally are also\n\trequired to apply for this License.  A Central License remains valid\n\tfor at least 1 year to the maximum period of 5 years and its\n\tRegistration fee is INR 7500 per year.\n<\/li><\/ul>\n\n\n\n<ul><li><strong>FSSAI State\n\tLicense<\/strong>&#8211; A food business with a turnover of more than INR 12\n\tlakh per year but less than INR 20 crore should go for State\n\tLicense. Such License is mainly for the restaurants\/food entities\n\twhich carry out operations in a single state only. The validity of a\n\tState License is 1 year to 5 years with an annual fee of INR 2000 to\n\t5000. \n\t\n<\/li><\/ul>\n\n\n\n<ul><li><strong>FSSAI Basic\n\tRegistration- <\/strong>Small food business operators that make a yearly\n\tturnover of less than INR 12 lakh only must register under basic\n\tFSSAI. The validity of a Basic License is also 1 to 5 years, yet its\n\tRegistration fee is cheapest, i.e. INR 100 per year. \n\t\n<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_for_Non-Compliance_of_FSS_Act_2006\"><\/span>Penalties for Non-Compliance of FSS Act, 2006<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>Following are the hefty penalties levied on the food business operators for not adhering to FSS Act:<\/strong><\/p>\n\n\n\n<ul><li><strong>Penalty for\n\tselling substandard food- <\/strong>In case aperson sells an\n\tinferior quality food which has been imported or produced by him,\n\tthen he will be a penalized with INR 5 lakh.&nbsp;\n<\/li><\/ul>\n\n\n\n<ul><li><strong>Penalty for\n\tmisleading customers with false advertisement- <\/strong>If a food outlet\n\tis found guilty of promoting false advertisements just to attract\n\tcustomers, it will be subject to pay the penalty up to INR 10 lakh.\n\t<\/li><li>&nbsp;<strong>Penalty\n\tfor food with extraneous matter- <\/strong>A food business operator who\n\tstores or sells any food article that contains extraneous matter\n\tshall be levied a penalty of about INR 1 lakh.&nbsp;\n\t<\/li><li><strong>Penalty for\n\tnot complying with Food Safety Officer- <\/strong>If a food operator fails\n\tto abide the orders of Food Safety Officer or do not comply with the\n\tprovisions of FSS Act, then a penalty of INR 2 lakh shall be imposed\n\ton him. In such a case, the only exemption is to provide a valid\n\treason for non-compliance.&nbsp;\n\t<\/li><li><strong>Penalty for\n\tunhygienic or unsanitary processing of food<\/strong>&#8211; Any person involved\n\tin food processing or manufacturing must maintain hygienic or\n\tsanitary conditions.
