Presently, the Cosmetic business is expanding rapidly in India, from TVs to social media platforms. People from whole the world use cosmetics, whether they are men or women. As we already know, power comes with responsibility, so the Cosmetic industry has attracted the Government due to its heavy demand for Cosmetic Products Manufacturer. In India, the CDSCO (Central Drugs Standard Control Organisation); before that, there was no provision related to it.

Currently, customers are curious to know the ingredients in the products and make choices about which one is good to buy. Therefore, to plan a new cosmetic business and conduct manufacturing, distribution and selling of the cosmetic products, you need to get CDSCO Cosmetic Manufacturing License first. Then, the registered cosmetics product must stick a unique label with the Registration Certificate Number. This article only discusses how to obtain Cosmetic Products Manufacturer License in India.

Regulatory Authority for Cosmetic Manufacturer License in India

The primary regulatory Authority for the Cosmetic Manufacturer’s License in India is the CDSCO. The CDSCO regulates all cosmetic product licenses and drugs. All the requirements regarding the CDSCO Cosmetic Manufacturer License are needed to have liaised and regulated by this body. The law controls the cosmetic business in India, the Drug & Cosmetic Act of 1940 and Rules, 1945[1]. aside from CDSCO, the Bureau of Indian Standards (BIS) guide various standards for CDSCO Cosmetic Manufacturing License in India. These bodies also regulate the ingredients in cosmetics.

Cosmetics Regulation for Cosmetic Product Manufacturer License

Drugs & Cosmetics Act, 1940, and New Cosmetics Rules 2020 control the Cosmetics products in India. For several years the State Drug Control Departments or State License Authorities (SLA) have been accountable for licensing and registration respecting the manufacturing of cosmetics and renewal of manufacturing licenses. For Cosmetic products to obtain approval in India, whether manufactured/imported, India needs to follow standards laid down by the Drugs & Cosmetic Act and Bureau of Indian Standards.

Cosmetics Products are sold packaged, so the manufacturer must comply with regulations laid down by the Legal Metrology Rules 2011 (packaged commodities). Controller or Director of Legal Metrology, New Delhi, also gives certification for cosmetic products.

Type of Cosmetic Product Registration in India

The following is the registration required for the manufacturing and distribution of Cosmetic Products in India according to the Drugs & Cosmetics Act, 1940.

  1. License on form 32 is a grant for the manufacture/ sale distribution of cosmetics products in India. (Form no 31)
  2. License on Form 32-A is issued for loan license for manufacture/ sale distribute of cosmetics. (Form no. 31-A)
  3. License on form 37 is a grant for grant or renewal of approval for conducting tests on drugs/cosmetics products or raw material used in the manufacture thereof on behalf of licensees for manufacture for sale of drugs/cosmetics. (Form no. 36).
  4. The license in Form 42 for importing cosmetics products from other nations.

Documents Required for the Obtaining Cosmetic Products Manufacturer License in India

  • Form-32 for manufacturing of cosmetics;
  • Fee deposited cost;
  • Blueprint of Site Plan & Key Plan;
  •  proof of ownership of the premises, in case of rent;
  • Basis of occupation of the premises;
  • proof of a Certified copy of the constitution of the firm;
  • Declaration form;
  • Affidavit of non-conviction of Partners/ Directors/Proprietorship under Drugs & Cosmetics Act, 1940;
  • Affidavit letter of a registered pharmacist/competent or skilled person regarding full-time working with the firm correctly attested by Notary;
  • Bio-data form;
  • verify a copy of the Registration Certificate and Experience Certificate of the Registered Pharmacists/skilled person and qualification certificates;
  • Appointment letter of a registered pharmacist/competent or skilled person in charge, if an employed person.

Procedure for getting Cosmetic Products Manufacturing License in India

  1. Filling of Application: First, you require applying for a Cosmetic Products Manufacturer License.
  2. Submit your Documents and Payment of Fee: After applying, you must submit all the essential documents and require payment of fees.
  3. Inspection: Once you submit the application and documents to CDSCO, they will examine them.
  4. Issuance of License: after the Authority is satisfied with all the applications and documents, they will grant you the Cosmetic Products Manufacturer License.

Regulation for Manufacturers Concerning Labelling of Cosmetic Products

The list below contains the labeling requirements as per the Drugs and Cosmetic Rules, 1945:

  • The product’s name ought to be mentioned on the inner and outer labels, and if the container is not significant, then the principal place & the pin code are acceptable.
  • The outer label must reflect the ingredients used in the Cosmetic product’s manufacturing.
  • The inner label should surround the direction of use and necessary warnings to ensure safety.
  • Must mention a separate manufacturing batch preceded by a letter with “M” and batch number “B”  on the label.
  • The Bureau of Indian Standards (BIS) performs a quality check of these Cosmetic products from time to time and makes essential changes in the Indian standard.
