A complete guide to Trademark Class 3 of the Trademark Classification. Trademark Registration should be done underclasses, and each class shows a unique class of products or services. Trademark Class 3 is for incorporating soaps, essential oils, cosmetics, perfumes, and hair lotions. Trademark Class 3 mostly comprises cosmetics and cleaning products used for cleaning, laundering & bleaching preparations, abrasive and scouring preparations, cosmetics, essential oils, etc. Class 3 of Trademark is one of the 45 Trademark Classes which is used by the USPTO (United States Patent and Trademark Office)[1] when a grouping of goods or services.

Various products and services have been categorised by the International (Nice) Classification of Goods & Services into 45 different Trademark Classes, from 1 to 34 covers goods, and 35 to 45 covers services. The Trademark Registry in India uses these to categorise the Trademarks. In this blog, we know the list of all cosmetics and cleaning products in Trademark Class 3.

Some Examples of Trademark Class 3

Following is the list of goods that you have to choose Trademark Class 3 if you were registering any of these goods:

  1. Deodorants for animals or humans;
  2. Room fragrance preparations;
  3. Sanitary preparations being toiletries.

Following is the list of all goods that you have to choose Trademark Class 3 if you were registering:

  1. Chemical chimney cleaner;
  2. Degreasing preparations for use in manufacturing processes;
  3. Deodorants other than hums or for animals;
  4. Sharpening grindstones & stones.

In case if you are not sure about registering in Class 3, you may also deem the following coordinated classes:

  • Class 5: Pharmaceuticals;
  • Class 21: Households Utensils;
  • Class 35: Advertising & Business Services;
  • Class 42: Science & Technology Services;
  • Class 44: Medical & Vet Services.

A coordinated class is one that is associated with another class; this is because the USPTO has found out that applicants filings within Trademark Class 3 often need to apply in the coordinated classes also.

The Trademark Registration is done on a class system. For each class of goods or services that is incorporated, a separate registration fee is paid. The correct class must be shown at the time of applying for a Trademark Registration because if the class is found incorrect, then the process of application begins all over again.

Specimens for Trademark Class 3

If the mark or logo is used in commerce, then you should provide a specimen of this logo or mark as clients see it. It is vital for the specimen to indicate the mark as used on or in connection with the goods in commerce. A Trademark specimen must be a label, tag, or container for the goods or an exhibit that is linked with the products or goods. A copy or any other reproduction of a specimen of the mark as used in or on association with goods is acceptable.

In most situations, the label is an acceptable specimen if the Trademark is applied to the goods or the containers for the products or goods in Trademark Class 3 by means of labels.

Shipping labels or mailing may be accepted if proper usage is shown and if they are fixed to the products or to the containers for the products. It is not satisfactory if the mark displayed is just used as a Trade Name and not a Trademark.

The correct way of Trademark Affixation is to stamp a Trademark on the products, the container, or on the tags or labels attached to the containers or goods. The Trademark can be inscribed on the goods’ body, with metal stamping; it can be applied by a rubber stamp or be selected by using a template/stencil. A Trademark used in this way, facsimiles or photographs representing actual stencilling or stamping are acceptable as specimens.

The words ‘applied to the containers for the goods means that it is applied to any sort of commercial packaging that is usual for that specific goods as they move in trade. Hence, an indication of Trademark on the standard retail package for the specific Trademark Class 3 goods is a satisfactory specimen.

A specimen displaying the Trademark use on a vehicle in which the goods are being marketed to the applicable purchasers can constitute the mark used on a container for goods if this is the standard mode of use of the mark for those specific goods.
