The Ministry of Housing and Urban Poverty Alleviation on March 26, 2016, introduced a new notification of Real Estate (Regulation and Development) Act 2016 (RERA) provisions in Delhi. It stated that the interest of the buyers now stands protected, as a person can easily file a complaint in RERA Delhi. On obtaining the RERA Registration, the RERA Delhi ensures great accuracy, clarity and accountability in the Real Estate Transactions applied on existing and new projects. Therefore, this article will help you in understanding the complete process to file a complaint in RERA Delhi.

Who are the authorities to file a complaint in RERA Delhi?

A complaint in RERA Delhi can be filed before the three authorities depending upon the nature of grievances. Such three authorities are as follows:

RERA Authority

The aggrieved buyer, agent or builder can file a complaint to the Delhi RERA Authority in case there is a violation of the RERA Rules and RERA Act. Such complaint is filed in the application in FORM M to the authority.

RERA Adjudicating Officer

The aggrieved person being the buyer, agent or the builder can file a complaint in Form N with the RERA Adjudicating officer in a case where there is a matter of loss or damage incurred due to the false or incorrect information in the prospectus, any damage or loss due to any defect in the provision of the services or defect in structure or any loss because of the delay in the completion of the project.

RERA Tribunal

Any person may approach the Delhi State RERA Tribunal by filing an appeal in Form L, who is aggrieved by the decision of the Delhi RERA Authority and the RERA Adjudicating officer.

What is the process to file a complaint in RERA Delhi?

Step 1: In order to file a complaint in RERA Delhi, the aggrieved person must visit the state’s official website portal and click on a “File Complaint” link under the “Complaint” tab. A login ID is required to be created with the user type as “Complaint”. Then the complainant is required to fill all the information and click on the “Create User” button. The confirmation email with a link will be sent to the email id as provided by the user. Click on to the link to verify and activate the user account.

Step 2: The next step that involves in the process to file a complaint in RERA Delhi is that the complainant is required to log in to the web portal by typing the user name and the password set in the first step and complete the rest required information by going to the “My Profile” section. Multiple complaints can be files through the same profile.

Step 3: The complainant is required to select the type of complaint he needs to file with the authority. Complainant’s particular must be auto-filled based on the information provided in a “My Profile” section.

Step 4: Further, all the required information must be filled in a selected form. Tooltips in each of the fields have been provided for the assistance of the user in the form.

Step 5: the complainant then is required to make the registration fee online to file a complaint in RERA Delhi, which stands to be Rs. 1000 per complaint. The payment can be done through credit card, debit card or through net banking facility.

Step 6: the complainant then has to upload the relevant documents related to the complaint. A Vakalatnama[1] is a prevailing format is required to be uploaded if the complaint is represented by the Legal Practitioner. The same is to be downloaded from the documents tab of the official website.

Step 7: the final step involved to file a complaint in the RERA Delhi is to submit the complaint by clicking on the “Submit” button and complaint reference number shall be generated, which the complainant must note down for future reference.

What are the important details that are required to be mentioned to file a complaint in RERA Delhi?

To file a complaint in RERA Delhi, it must be done in the prescribed Form M, Form N or Form L basis. And if it is filed with the RERA Tribunal, then the complaint must be filed in the form of an Appeal against any order that is passed by the RERA Authority and the RERA Adjudicating Officer. While drafting a RERA Complaint, the following details must be included: –

  • The buyer’s name, address and other details.
  • The address of the respective project.
  • The Property’s registration number.
  • The statements and facts relating to the delay in the property.
  • The response was given by the project developer.
  • The relief that is sought from the RERA Authority.

The complaint along with the prescribed fee for the different forms as per the Delhi RERA Rules is filed with the RERA Delhi. The time period to dispose off a complaint or an appeal is within a period of 60 days from the date of the receipt of an application by the RERA Authority. If the application is not disposed off within the said prescribed period, the authority is required to record the reasons in writing for not disposing off the application within that period.

Reasons to file a complaint in RERA Delhi

A complaint can be filed with the Delhi RERA Authority by a buyer for any violation or contravention of the RERA Act provisions by a promoter, builder, real estate agent or developer. The reasons under which the buyer can file a complaint in the RERA Delhi are: –

  • False Advertisement.
  • Delay in Possession.
  • The project is improperly registered.
  • When the advance payment is made by the buyer.
  • Defects in structure.
  • The details of the project are not correct.
  • Defects in the transfer of ownership.

The RERA Authority ensures the registration of the Real Estate Agents and Real Estate Projects. The important function of the RERA Authority is to redress the complaints made by the buyers, builders and agents and to look into the immoral and unethical practices conducted in the Real estate Sector.
