The term “Trademark Class 12” denotes a class that deals explicitly with the goods and items, such as vehicles, devices, machines, vehicle part, and equipment used for locomotion by air land, or water.

Concept of Trademarks Registration in India

The groups or the classes under which a ‘manufacturer’ or a ‘service provider’ can apply for the Registration under the Trademarks Act are termed as ‘Classification for Trademark’.

Further, these classifications are derived on the basis of “NICE Classification”.

Currently, there are 45 distinctive Classifications of Trademark given under the provisions of the Trademarks Act 1999.

Furthermore, classes 1 to 34 are categorized as ‘Trademark Classes for Goods’ or ‘TM Classes for Goods’, and the residual classes, i.e., classes 35 to 45, are classified as ‘Trademark Classes for Services’ or ‘TM Classes for Services’.

Further, it will be significant to mention that at present, there are approx. 8000 plus services and goods listed under the heading of the Trademark Classifications guide.

  9. Human-powered Trolleys and Carts;
  10. Motors, Engines, Parts and other Fittings used for diverse Land Vehicles;
  11. Diverse Water Vehicles and several Fittings;
  12. Couplings and Transmission Components used in Vehicles;
  13. Air Cushion Vehicles;

Items Not Included under Trademark Class 12

The items not included under Trademark Class 12 are as follows:

  1. Metals and Material used in Railways under the Trademark Class 6;
  2. Motors, Engines, Couplings, and Transmission Components used in Vehicles other than for Land Vehicles under the Trademark Class 7;
  3. Parts of Machines under the Trademark Class 7;

The term “Related Classes” signifies an event in which a particular good or service falls under more than one Classes for Trademark.

Also, the classifications or classes that have a ‘close association’ with the Goods mentioned under Trademark Class 12 are as follows:

  1. Common Metals under the Trademark Class 6;
  2. Computer and Scientific Devices under the Trademark Class 9;
  3. Machines under the Trademark Class 7;
  4. Building Materials under the Trademark Class 19;
  5. Furniture under the Trademark Class 20;
  6. Advertising and Business Services under the Trademark Class 35;
  7. Construction and Repair Services under the Trademark Class 40;
  8. Medical Treatment Services under the Trademark Class 42;
  9. Construction and Repair Services under the Trademark Class 37;

Further, the idea of Coordinated Classes was determined by the ‘USPTO’ orUnited States Patent and Trademark Office’.

Moreover, as per the United States Patent and Trademark Office, any applicant or individual who desires to apply under Trademark Classes 12 of the Trademark Classification, must submit an application for Registration in all the other related classes also.
