The Gujarat Real Estate Regulatory Authority or RERA in Gujarat popularly known as GUJRERA came into force in May 2017, when the state government approved Gujarat Real Estate Rules 2017.

Further, to keep the Real Estate Act 2016 at its basic, the GUJRERA attempts to make real estate transactions, delivery, dealings, and information as crystal clear and transparent as possible.

Concept of RERA in Gujarat

As per the provisions of the RERA Act 2016, it is obligatory and compulsory for every Indian State to have a RERA Authority of its own. Further, the main aim behind the implementation of state RERA is to administer and govern the real estate sector within the state limits.

Moreover, the Gujarat RERA Act was passed inMay 2017, and till date, it carries out all the functions and operations as prescribed under the parent act and regulates every segment of the real estate industry in Gujarat as well.

At present, there are 7704 projects and 1317 agents registered, 2559 projects completed, and 2135 complaints resolved under GUJRERA.

Home Buyers

The services provided to the Homebuyers by the GUJRERA are as follows:

  1. Facility to Lodge Online Complaint against Builder or Developers;

Promoters

The services provided to the Promoters by the GUJRERA are as follows:

Real Estate Agents

The services provided to the Real Estate Agents by the GUJRERA are as follows:

Applicability For RERA Registration in Gujarat

The ones who are eligible for obtaining RERA Registration in Gujarat are as follows:

  1. Any person who constructs or builds a building or a building of apartments;
  2. Any person who modifies or renovates an existing structure into apartments to sell other people;
  3. Any person who develops land into a real estate project to sell the same to other people;
  4. Plots or buildings constructed by any recognised authority or public body on the property owned by the government;
  5. Any primitive cooperative or state-level housing finance society that constructs building or apartments for its members or allottees;
  6. Any person who operates as a builder, contractor, estate developer, colonizer, developer, or claims to be the holder of Power of Attorney, acquired from the owner of the property on which such a building or plot is being constructed or developed;

Documents Required for Real Estate Registration under RERA in Gujarat

The documents required for obtaining Registration under RERA in Gujarat are as follows:

Registration certificate of the company.

  1. Certificate of Registration for the Company;
  2. Latest passport-sized photograph for Promoter;
  3. Photographs for the Real Estate Project;
  4. Certificate of Project Completion for any previous project;
  5. Architect certificate in Form 1;
  6. NOC (No Objection Certificate) in Form 1A;
  7. Photographs of the block/wing/building/ floor;
  8. NOC in Form 1B;
  9. Engineer Certificate in Form 2;
  10. Certificate from Practising Chartered Accountant in Form 3;
  11. Balance Sheet for the previous 3 financial years;
  12. Profit and Loss statement for the previous 3 financial years;
  13. Directors’ Report for the previous 3 financial years;
  14. Cash Flow Statement for the previous 3 financial years;
  15. Auditor Report;
  16. Acknowledgement for Income Tax Return;
  17. A copy of the PAN Card;
  18. Encumbrance Certificate;
  19. Certificate of Commencement;

The documents required for obtaining Real Estate Agent Registration under RERA in Gujarat are as follows:

  1. Brief Details regarding the individual or enterprise, such as name, type of enterprise, registered address, etc.;
  2. Particulars for Registration, such as follows:
  3. Memorandum of Association;
  4. By-laws;
  5. Articles for Association;
  6. Name of the individual or entity;
  7. Contact details, such as the mobile number and email address;
  8. Latest passport-sized photograph of the real estate agent;
  9. Address of the Registered Office;
  10. Latest passport-sized photographs for all the partners or directors;
  11. A copy of the PAN Card;
  12. Address Proof of the Registered Office;

Process to obtain Real Estate Project Registration under RERA in Gujarat

The steps involved in the process to obtain Real Estate Registration under RERA in Gujarat are as follows:

Visit the Official Website

In the first step, the applicant requires to visit the official GUJRERA portal[1].

Now, the applicant requires to click on the option “Project Registration”, located at the end of the homepage.

After clicking on “Project Registration”, the applicant will be re-directed to a new page wherein he/she needs to choose the type of promoter from the two option given.

Enter Promoter Details

In the next step, the applicant requires to provide promoters details, such as Email Id, PAN Card, Mobile Number, CIN (Company Identification Number).

After that, the applicant requires to provide additional details as follows:

  1. Authorised Signatory;
  2. Project Head;
  3. RERA Registration Number;
  4. Previous Project Details;

Enter Project Details

The applicant requires to enter details as follows:

  1. Real Estate Project Name;
  2. Project Description;
  3. Project Commencement Date;
  4. Total Land Cost;
  5. Total Project Cost;

Enter Development Details

The Development details section includes the information as follows:

  1. Type of Inventory;
  2. Number of Inventory available for Sale;
  3. Carpet Area;
  4. Balcony Area;
  5. Area of Private Open Terrace;

Enter Internal Development Work Details

The details to be furnished in the Internal Development Work Details section are as follows:

  1. Road System;
  2. Water Supply;
  3. Sewage and Drainage Facility;
  4. Supply of Electricity;
  5. Solid Waste Management;

Provide Project Bank Details

The term project bank details include the information as follows:

  1. Bank Details;
  2. Bank Branch Name;
  3. Account Name;
  4. IFSC Code;

Provide Real Estate Agent Details

The term real estate agent details include the information as follows:

  1. Agent Registration Number;
  2. Name of the Real Estate Agent;
  3. Registered Office of the Real Estate Agent;
  4. PAN Card details;

Enter Real Estate Project Architect Details

The details to be furnished in Real Estate Project Architect Details section are as follows:

  1. Name of the Architect;
  2. Email Address of the Architect;
  3. Number of Completed Projects;
  4. Local Authority;
  5. License Number;

Fill in Project Structural Engineer Details

The Project Structural Engineer details section includes the information as follows:

  1. Name of the Engineer;
  2. Email Address of the Engineer;
  3. Number of Key Projects Completed;
  4. Year of Commencement;

Upload Required Documents

Once all the details are filed, the applicant will then require to upload all the documents specified.

Make Online Payment

After successfully submitting the form, the applicant needs to make the payment of the Fee prescribed for obtaining registration under RERA in Gujarat. Further, the applicant will be re-directed to the payment gateway, wherein he/she needs to provide the user name and password to make an online payment. After that, click on the option “Agree and Pay” to remit the fee for registration.

Receive Acknowledgement

Once the applicant has successfully made the payment, he/ she will then receive a message that the details of the said real estate project have been submitted successfully. Also, he/she will receive an acknowledgement number which can be used for future reference.

Now, the applicant requires to click on the option “Agent Registration”, located at the end of the homepage.

After clicking on “Agent Registration”, the applicant will be re-directed to a new page wherein he/she needs to choose the type of agent from the two option given.

Enter Agent Details

In the next step, the applicant requires to fill-in agent details, such as Name, Email Id, PAN Card, Mobile Number, CIN (Company Identification Number).

Upload Required Documents

Once all the details are filed, the applicant or the agent will then require to upload all the documents specified.

Make Online Payment

After successfully submitting the form, the applicant needs to make the payment of the Fee prescribed for obtaining real estate agent registration under RERA in Gujarat. Area exceeding 1000 sq. mtr: Rs 10 per sq. mtr. (Maximum of Rs 5 lakhs)

Mixed Development Project (Residential and Commercial)

Area not exceeding 1000 sq. mtr: Rs 10 per sq. mtr.
Area exceeding 1000 sq. mtr: Rs 15 per sq. mtr. (Maximum of Rs 10 lakhs)

Commercial Project

Area not exceeding 1000 sq. mtr: Rs 20 per sq. mtr.
Area exceeding 1000 sq. mtr: Rs 25 per sq. mtr. (Maximum of Rs 10 lakhs)

Plotted Development

Rs 5 per sq. mtr (Maximum of Rs 2 lakhs)

Withdrawal of Application for RERA Registration

5% of the total Registration Fee or Rs 25000 (whichever is higher)

Extension of RERA Registration of the Real Estate Project

Amount corresponding to the half of the total registration fee.
