  4. If Repair, Re-development, or Renovation does not include Selling, Marketing, Allotment, or Advertising of new plot, apartment, or building;

In the first step, the applicant or the promoter needs to visit the Official Website of Bihar RERA[1].

In the next step, the applicant requires to click on the option saying “Project Registration” to get redirected to the next page.

Now, the applicant needs to first choose the option “Promoter”, and enter the required information, such as:

  1. Type of Promoter;
  2. PAN No;
  3. Email ID; and
  4. Mobile Number;

After entering all the information, the applicant needs to click on “Register” to complete the process of RERA Registration.

Now, the applicant needs to first choose the option “Real Estate Agent”, and enter the required information, such as:

  1. Type of Promoter;
  2. PAN No;
  3. Email ID; and
  4. Mobile Number;

After entering all the information, the applicant needs to click on “Register” to complete the process of RERA Registration.

Registration Fee for Bihar RERA

The Registration Fees for Bihar RERA are as follows:

Group Housing

Rs 5 per sq mtr

It is applicable to the projects where the land area does not exceed 1000 sq mtrs.

Rs 10 per sq mtr

It is applicable to the projects where the land area exceeds 1000 sq mtr. However, such an amount cannot exceed Rs 5 lakhs.

Mixed Developments

Rs 10 per sq mtr

It is applicable to the projects where the land area does not exceed 1000 sq mtrs.

Rs 15 per sq mtr

It is applicable to the projects where the land area exceeds 1000 sq mtr. However, such an amount cannot exceed Rs 7 lakhs.

Commercial Projects

Rs 20 per sq mtr

It is applicable to the projects where the land area does not exceed 1000 sq mtrs.

Rs 25 per sq mtr

It is applicable to the projects where the land area exceeds 1000 sq mtr. However, such an amount cannot exceed Rs 10 lakhs.

Plotted Development Projects

In these projects, the fees charged will be Rs 5 per sq mtr. However, such an amount cannot exceed Rs 2 lakhs.

The steps involved in the process to register a Complaint under RERA in Bihar are as follows:

In the first step, the applicant or the promoter needs to visit the Official Website of Bihar RERA.

In the next step, the applicant requires to click on the option saying “Register Complaint” to get redirected to the next page.

In this step, the applicant needs to fill in all the details asked in the Complaint Registration Form and requires to upload all the supporting documents.

Make Payment

Now, the Complainant needs to pay the fees of Rs 1000 for filing complaints. The complaint can make payment only through DD (Demand Draft) or Cheque.

Further, the DD or Cheque should be in favour of ‘Real Estate Regulatory Authority Bihar’ and payable at Patna Branch.

After that, the complainant needs to check all the boxes of the declarations. The reason behind such declaration is to check that all the information provided by the complainant is the best of his/her knowledge and is within the jurisdiction of the Authority.

Lastly, click on the option “Submit” to complete the Complaint Registration Form. However, it is significant to note that the complainant must note the “Reference Number” for future use.

Penal Provisions under RERA in Bihar

If in case a Promoter fails to register his/her Real Estate Project under the RERA in Bihar, then he/she will be liable to pay the penalty up to 10% of the Total Estimated Cost of the said Project.

However, suppose in case the violation continued. In that case, the Promoter will be liable for an Imprisonment up to 3 years or for a fine of further 10% of the Total Estimated Cost of the Project, or even with both as per the Rule 35 of the Bihar Real Estate (Regulation and Development) Rules 2017.

Besides the RERA Registration, the Promoter also needs to provide the Quarterly Updates on the status of the Project to the Authority.
