The Madhya Pradesh Real Estate Regulatory Authority or RERA in Madhya Pradesh commonly called MPRERA was enforced by the state government on 22.10.2016. Further, the main objective behind the implementation of MPRERA was to regulate and boost the Real Estate Industry of the state.

  5. Bank details of the “Escrow Account” which is having at least 70% of the total amount collected from the allottees.

Documents Required for Registration under RERA in Madhya Pradesh

The documents required to Register a Project under RERA in Madhya Pradesh are as follows:

  1. A copy of By-Laws.
  2. A copy of MOA and AOA.
  3. Latest passport size photograph for the Promoter.
  4. Latest passport size photographs for the director, chairman, and all the other members in case the promoter is a firm or private company.
  5. PAN Card and Aadhaar Card of the Promoter/Developer.
  6. PAN Card or Aadhaar Card copies of the director, chairman, and all the other members in case the promoter is a firm or company.
  7. Audited Balance Sheet, P & L Account, Auditors Report, and Income Tax Returns of the promoters for the previous 3 financial years.
  8. Legal Title Deed to show that the promoter has the absolute right over the project proposed.
  9. Non-Encumbrance Certificate granted by the Revenue Authority who is not lower than the Tehsildar.
  10. Particulars of the Encumbrances on the proposed Property.
  11. NOC from the owner of the property.
  12. A copy of the approvals received by the competent authority;
  13. A copy of the Commencement Certificate issued.
  14. Layout Plan, Sanctioned Plan, Specifications of the Project approved by the competent authority.
  15. Address Details of the Project, together with its location in the longitude and latitude of end-points.
  16. Details about the Area of the Apartment offered for Sale;
  17. Performa of the Allotment Letter.
  18. Agreement for Sale
  19. Conveyance Deed
  20. Number and Area of Garage offered for sale in the proposed project.
  21. Number of open spaces given for parking in the project.

Process to Register Promoter under RERA in Madhya Pradesh

The steps involved in the process to register Promoter under RERA in Madhya Pradesh are as follows:

In the first step, the applicant or promoter needs to visit the Official Madhya Pradesh RERA Portal[1].

In the next step, the applicant requires to click on the second last option from the dashboard, i.e., Registration. After that, choose the option “Project Registration” from the drop-down menu.

Now, on the same page, click on the “proceed” button, located at the end of the instruction manual.

Now, in the next step, the applicant will be redirected to a new webpage, named as “Project Registration”.Over here, the form will be divided into 3 parts, i.e., Promoter Details, Project Details, and Bank Details. Also, the applicant/promoter requires to upload the necessary documents as well.

Now, the applicant requires to press the button “Make Payment” to proceed further for payment. After that, click on “Confirm” to complete the process of registration.

Fee Structure under RERA in Madhya Pradesh

For New Projects:

Plotted Residential Projects  Rs 10 per Sq. mtr. X Floor Area Ratio;
Constructed Residential Projects Rs 10 per Sq. mtr. X Carpet Area of the Residential Units + Rs 20 per Sq. mtr. X Carpet Area of the Commercial Units; 
Plotted Commercial Projects  Rs 20 per Sq. mtr. X Floor Area Ratio x Area of the Total Plotted Land; 
Constructed Commercial Projects Rs 20 per Sq. mtr. X Carpet Area of all the Constructed Commercial and Non-Residential Constructions; 
Mixed Projects  Fee determined in ratio to the Proposed Residential and Non-Residential Area; 

For Ongoing Projects:

Rejection of Application under RERA in Madhya Pradesh

In case a developer/promoter applies for the withdrawal of registration of the real estate project or in case the authorities decide to reject the application filed, then the paid RERA registration fees in India is refunded within a period of 30 days, after deducting 10% from the amount paid.

Validity of Registration under RERA in Madhya Pradesh

If in case the details furnished are correct and accurate as per the guidelines issued, a Certificate of Registration will be issued to the developer/promoter, which is valid for 5 years.
