RERA in HP: How to Register a Real Estate Project and Agent?

The main aim behind the establishment of RERA in HP was to give a boost to the state’s Real Estate Sector. By this decision, the government has opened the gateway for the investors residing outside Himachal Pradesh.
In this blog, we will talk about the enforcement of RERA in HP, and the procedure to register a real estate project and real estate agent.
Concept of RERA in HP
Due to the immense potential and establishment of RERA, developers from the various corners of the world eagerly want to invest in Himachal Pradesh. As a result, there is a considerable increment in the number of home-buyers.
Further, the State Government had announced the regulation for RERA Registration in Himachal Pradesh on 28.07.2017. These regulations are known as the Himachal Pradesh Real Estate (Regulation and Development) Rules, 2017.
These rules prescribe the procedure for RERA Registration, Constitutions of RERA Authority, Filing of complaints before Authority, and Complaint Redressal System.
Till date, 58 Residential Projects have obtained RERA Registration under the regulation mentioned above.

Need for RERA in HP

There were several issues that a home investor or buyer used to face before the implementation of RERA in HP, which are as follows:
- Delay in Delivering the Possession of the Property;
- Non-payment of Penalty and Interest;
- Sale of one Flat to Several Home Buyers;
- Redundant demands by Builders;
- Construction stopped on the Project;
- Cancellation of the Real Estate Project;
Documents Needed to Obtain RERA Registration in HP
The documents required for RERA Registration in HP are as follows:
Property Related Documents
- Allotment Letter in favour of the Allottee;
- Agreement for Sale in favour of the Allottee;
- Possession Letter in favour of the Allottee; and
- Conveyance Deed in favour of the allottee;
- Details of Project Professional and their respective Certificates;
- Checklist for Civic Facilities;
- Certificate for Structural Liability;
- Project Plan;
- Sanctioned Plan;
- Location Plan;
- Himachali Agriculturist Certificate or the Certificate issued under “Section 118 of H.P.T and Reform Act, 1972”.
Personal Documents
- PAN Card of the Applicant;
- Aadhaar Card Number of the Applicant;
- Latest Passport-sized Photograph;
- ITR (Income Tax Return) Acknowledgement Report for the last 3 years;
- Annual Financial Report, including the Profit and Loss Account, Audited Balance Sheet, Auditors Report, Cash Flow Statement, and Directors Report;
- Details of the Current Bank Account wherein a Security Deposit is maintained;
- Ownership Deed of the Land;
- Latest Revenue Documents, such as the
- Jamabandi;
- Tatima;
- Demarcation Report; and
- Non-Encumbrance Report.
Process to Register a Real Estate Project with HP RERA
Normally, registering a Real Estate Project with HP RERA is a time-consuming and back-breaking process. In total, there are 7 pages that are to be filled, and more than 10 different documents are required to be uploaded on the portal. The steps involved in the process to register a Real Estate Project in Himachal Pradesh are as follows:

Visit the Official Portal

Visit the Official HP RERA Portal at http://www.hprera.in/WebSite/Home.
First Time Registration

For the first time registration, the applicant needs to first register as a “Promoter”. So, click on the option “Register” located at the top right of the webpage.
Select Promoter

After selecting the option “Register”, the applicant needs to click on the option “Promoter”.
Fill in Details

Now, the applicant requires to fill in all the information asked and need to upload the necessary documents on the portal.
Create a Profile

After filing the form, choose “Save” to Create a Profile. With this profile, the applicant can move further towards the process of registration.
Go Back to Home Page

In this step, the applicant needs to go back to the Home Page and select the option “Registration” from the tab.
Choose Real Estate Project

After that, he/she needs to click on the “Real Estate Project” option. After that, choose either “Apply for New Project” or “Apply for Ongoing Project” based on the requirement.
Log in to Promoter Account

Now, the applicant will be redirected again to the page wherein he/she needs to log in to his/her “Promoter Account”.
7 Different Pages For HP RERA Applicant
At this stage, there are 7 different pages that an applicant needs to fill in, such pages are:
Promoter Profile
In this section, the applicant will fill all the relevant personal and financial details.
Project Details
This section deals with Project Information, such as the location, ownership, and size.
Sanctioned Business Plan
This section relates to the information of Sanctioned Business Plan, such as Structural Stability Certificate, Sanctioned Plan, Type of Project, etc.
Civic Facilities
This section will provide a checklist of facilities from which the applicant needs to select the relevant ones.
For example, if a real estate project has septic tanks installed or uses Renewable Energy, the applicant must select the matching options.
Project Professionals
Here, the applicant will provide the details and names of the professionals involved in the real estate project. Further, he/she also need to upload a copy of their respective certificates.
Project Fees
In this section, the project fee is calculated based on the type and size of the real estate project and land. It shall be relevant to note that the only mode to make the payment of registration fee is through online banking.
Project Declaration
The last section, i.e., “Project Declaration” Page is the “Form B”, where the applicant needs to go through an “Affidavit cum Declaration” and verify all the documents submitted.
Further, the applicant can also save the application form as a “Draft” and get back to file it afterwards. However, if the applicant wants to submit the application form, then he/she click on “Final Submit”.

What is the validity of RERA Registration in HP
Normally, in Himachal Pradesh, the RERA Registration remains valid for the period submitted by the Promoter in his/her application form.
However, the applicant can get the registration period extended up to 1 year by filing an application to the RERA Authorities.
Documents Needed to Obtain Real Estate Agent Registration
The documents required to obtain Real Estate Agent Registration under RERA in HP are as follows:
- Duly attested application form;
- Details regarding the Type of Organization, i.e., Private Limited Company/ Public Limited Company/ Limited Liability Partnership/ Sole Proprietorship Firm;
- PAN Card details;
- Aadhar Card Number;
- A copy of resolution concerning authorization;
- Address proof of the registered office;
- Details of Registration in other States/Union Territories;
- Prior Experience Certificate;
Process to Register a Real Estate Agent with HP RERA
The procedure to obtain registration for a Real Estate Agent under RERA in HP is almost similar to the process of obtaining RERA registration for a real estate project. However, in this case, there is no need to involve a lot of documentation.
Further, the steps involved in the registration of a Real Estate Agent under RERA in HP are as follows:

Visit the Official Portal

Visit the Official HP RERA Portal at http://www.hprera.in/WebSite/Home.
First Time Registration

For the first time registration, the applicant needs to first register as an “Agent”. So, click on the option “Register” located at the top right of the webpage.
Select Agent

Now, after selecting the option “Register”, the applicant needs to click on the option “Agent”.
Fill in Details

Now, the applicant requires to fill in all the information asked and need to upload the latest passport-sized photograph.
Create a Profile

After filing the form, choose “Sign-up” to Create a Profile. With this profile, the applicant can move further towards the process of registration.
Go Back to Home Page

In this step, the applicant needs to go back to the Home Page and select the option “Registration” from the tab.
Choose Real Estate Agent

Thereafter, he/she needs to click on the “Real Estate Agent” option. After that, choose “New Registration” to sign-up to your Real Estate Agent Account.
Log in to Real Estate Agent Account

Now, after clicking the option “New Registration”, the applicant will be redirected again to the page wherein he/she needs to log in to his/her “Real Estate Agent Account”.
Fill in Details
Once the proposed Real Estate Agent has signed-up to his/her account, he/she can now proceed with filling the remaining “Real Estate Agent Registration Form”.
Unlike the “Real Estate Project Registration Form”, there are only two sections that are to be filled here, which are as follows:
Registration
In this section, the applicant needs to enter and provide his/her basic information and upload the necessary documents.
Fee
In this section, he/she need to add the payment details. Further, the modes of paying the registration fee are by using a DD (Demand Draft), a Cheque, or by way of Online Payment Mode, i.e., Net Banking.
Verify the Information Submitted
Now, after filling all the relevant boxes with details, the last step is to cross-check or verify the details filled.
After verifying the details filed, click on the option “Final Submit” to initiate the process to obtain the “Real Estate Agent Registration Certificate”.

Validity of Real Estate Agent Registration Certificate in HP
As per RERA in HP, the Real Estate Agent Registration Certificate of an agent remains valid for a period of 5 years, starting from the date of registration. The period of 5 years can further be extended after filling an application form to the RERA Authorities.
However, in case of the violation of any rules and regulations prescribed by the Real Estate Agent, the RERA Authorities has the power to revoke or cancel the Registration under RERA in HP.
