Online Procedure for Trademark Registration in Bihar

Following is the online procedure for Trademark Registration in Bihar:

Step 1: Online Trademark Search: This will allow you to determine an identical Trademark that has already been registered with the Trademark Registry.

Step 2: Filing of Trademark Application Online: After completing the Trademark Search, the Trademark application can be filed with the Trademark Registrar.

The following information may comprise in the Trademark application:

  1. Trademark or Logo;
  2. Name of the applicant;
  3. Permanent address of the Trademark owner or the applicant;
  4. Trademark Class/Class Selection;
  5. Trademark used since the date;
  6. Brief description of the products or services;
  7. Trademark application allotment.

Step 3: Trademark Examination: The application can be examined by the Trademark Office for correctness & issue an examination report. The Trademark Officer has the authority to accept the Trademark application and further allow for the Trademark Journal publication.

Step 4: Publication of Trademark: If no objection is filed within 90 days of the Trademark publication, the mark will customarily be registered.

Step 5: Online Trademark Objection or Opposition Hearing: After submitting the documents & application, the Trademark officer might ask you some questions regarding your Trademark application. Then the officer will send a notice, and you need to reply to it within 30 days. If the hearing officer is satisfied, then the application will go to acceptance, or it will be posted for manual or online hearing in the respective Trademark Registry.

The 3rd party can also oppose your Trademark application. In that case or matter, you can submit a counter-statement to the Trademark Registrar within 2 months declaring why the opposition has been not appropriate. Then the Trademark Registrar may either disclose or reveal the opposition or call for a hearing.

Step 6: Trademark Registration Certificate: Once the hearing is finished Trademark Registrar is satisfied, then they will issue a Trademark Registration Certificate, and you can use the R symbol.
